§ 660.03 LITTERING AND DEPOSIT OF GARBAGE, RUBBISH, JUNK AND THE LIKE.
   (b)   Litter on Public Property. No person, regardless of intent, shall throw or deposit litter in or upon any street, tree lawn, sidewalk or other public property, except in public receptacles or in authorized receptacles for collection.
   (c)   Deposit of Litter in Receptacles so as to Prevent Scattering. Persons depositing litter in public or private receptacles shall do so in such a manner as to prevent it from being carried or deposited by the elements upon any street, tree lawn, sidewalk or other public or private property. If a receptacle is filled to capacity, such litter shall be properly disposed of elsewhere.
   (d)   Upsetting Public or Private Receptacles. No person shall upset a public or private receptacle designed or used for the deposit of litter or cause or permit its contents to be deposited or strewn on public or private property.
   (e)   Illegal Use of Litter Receptacles.
      (1)   No person shall dispose of household trash, business trash, building material, industrial waste or yard trash, accumulated in residences or places of business, in litter receptacles located on premises not owned or controlled by such person or without the permission of the person owning or controlling such premises.
      (2)   No person, without authority, shall upset, damage, tamper with or destroy a public or private receptacle designed or used for the deposit of litter or cause or permit its contents to be deposited or strewn in or upon any premises.
   (f)   Litter in Parks. No person shall throw or deposit litter in any park within the City, except in public receptacles and in such a manner as to prevent it from being carried or deposited by the elements upon any part of the park or upon any street or other public place. Where public receptacles are not provided, all such litter shall be carried away from the park by the person responsible for its presence and properly disposed of elsewhere as provided herein.
   (g)   Litter in Streams and Fountains. No person shall throw or deposit litter in any fountain, pond, lagoon, lake, stream, bay or other body of water in a park or elsewhere within the City.
   (h)   Sidewalks and Alleys to be Kept Free of Litter. Persons owning, occupying or in control of any public place or private premises shall keep the sidewalks and alleys adjacent thereto free of litter and shall maintain such receptacles as may be required by this section.
   (i)   Dumping Prohibited.
      (1)   No person shall dump any garbage or solid waste on any public or private property or on any place not licensed or designated as an authorized dumping site by the City Manager.
      (2)   The City Manager or his or her designee is hereby authorized to send written notice to violators to remove debris illegally dumped. If the violator fails to comply with this order within five (5) days, the City may remove the debris. The violator shall be liable for a civil penalty equal to three (3) times the cost of such removal services.
   (j)   Litter on Occupied Private Property. No person shall throw or deposit litter on any occupied private property within the City, whether owned by such person or not, except that the owner or person in control of private property may maintain authorized private receptacles for collection in such a manner that litter will be prevented from being carried or deposited by the elements upon any street, sidewalk or other public place or upon any private property.
   (l)   Litter on Vacant Lots. No person shall throw or deposit litter on any open or vacant private property within the City, whether owned by such person or not.
   (n)   Litter on Construction Sites.
      (1)   Each contractor shall be responsible for the job site in such a manner that litter will be prevented from being carried or deposited by the elements upon any public place or private premises.
      (2)   Litter or other debris, including dirt and mud, deposited as the result of a normal construction process upon any public or private premises, shall be removed.
   (o)   Penalty. Whoever violates any of the provisions of this section is guilty of a minor misdemeanor.
