(a) The procedure for designating an Historic District is as follows:
(1) Legal notice of intent to designate an Historic District shall be published in a newspaper of local distribution for three consecutive days. The notice shall include the general bounds of the Historic District and the date, time, and place of the public hearing.
(2) A public hearing shall be conducted by the Commission not sooner than seven days or more than thirty days after the legal notice announcing its place and schedule.
(3) Written correspondence pertaining to the proposed Historic District shall be accepted and recorded for a period of thirty days after the public hearing. This correspondence shall be retained in the official files of the City.
(4) The Commission shall make its recommendations to Council within ninety days after the public hearing.
(5) The Commission's recommendation to designate an Historic District shall include, but not be limited to, a description of the boundaries of the Historic District, a summary of the comments made at the public hearing and a summary of the correspondence received by the Commission.
(b) The procedure for designating an Historic Property that lies either within or without the boundaries of an Historic District is as follows:
(1) The Commission shall notify the owner(s) in writing by certified mail, return receipt requested, of any formal proposal to designate owner's(s') property as an Historic Property and shall deliver to the owner a copy of this Chapter.
(2) The Commission shall attempt to secure the owner's written consent to the Historic Property designation of the property, and if the owner is unwilling to so consent, then the Commission may:
A. Table the proposal; or
B. Schedule a public hearing as hereinabove required for Historic Districts, on the proposed Historic Property designation. A copy of the legal notice of the public hearing shall be mailed to the owner(s) by certified mail, return receipt requested.
(3) The property owner(s) shall be given not less than fifteen days after the public hearing to prepare written objections.
(4) The Commission's recommendation concerning Historic Property designation shall include a summary of the comments made at the public hearing and the objections raised by the owner(s) and a copy of the owner(s) written objections, if received.
(c) A copy of the Commission's recommendation to Council shall be transmitted to the Planning Commission.
(d) City Council may reject, amend, table or approve the recommendation of the Historic Preservation Commission, provided that Council holds a public hearing when there is an objection by an owner of a property to be designated an Historic Property or an objection to Historic District designation with the signatures of over thirty percent (30%) of the residents in a proposed Historic District.
(e) The Commission shall maintain minutes of all official meetings pertaining to the designation of an Historic District or Historic Property.
