1331.16 APPEALS OF PERMIT REJECTION.
   (a)    Appeals from any final decision of the City Manager, any other administrative officer of the City, or the Architectural Review Board, or any request for variance from this Chapter shall be made to the Board of Zoning Appeals pursuant to Section 1137.01 et seq. of the Codified Ordinances.
   (b)    No appeal or request for a variance may be granted unless the Board of Zoning Appeals finds that:
      (1)    Special circumstances or conditions exist which are peculiar to the sign and location which are not applicable to other signs similarly located; and
      (2)    The granting of such appeal or variance from this Chapter will not confer on the applicant any special privilege that is denied to other signs owners in the same area; and
      (3)    The granting of such appeal or variance will in no manner adversely affect the health, safety, and general welfare of persons residing or working within the vicinity of the sign location.
   (c)    A decision shall be rendered in writing by the Board of Zoning Appeals within sixty (60) days of the filing of the appeal. If an appeal is denied, the reasons for denial shall be stated in writing. If a decision is not made within such period, the application shall be deemed to be denied. (Ord. 13-2012. Passed 10-15-12.)
