1331.01 DEFINITIONS.
   As used in this Chapter, certain terms are defined as follows:
   (a)    "Building frontage," means the width of the building occupied by a business. When a business is located on a corner lot, both sides of the building facing the streets shall be considered as building frontage. For purposes of municipally owned parks, playgrounds, and other recreational properties on which no occupied building is located, building frontage shall mean the width of the property as measured between the side property lines at the public right-of-way.
   (b)    "City Manager" shall mean the person functioning as the City Manager or other chief executive officer of the City of Wyoming, or such person's designee.

   (c)   “City Sponsored Event” is a fair, festival, parade, concert, performance, or other activity that is planned, organized, managed, and funded by the City and that is held, originated, and/or terminated on the Village Green and/or the adjoining streets and that is convened for the benefit of the residents of the City of Wyoming.

   (d)    "Clear Visibility Triangle" shall mean the area formed by drawing a line thirty feet (30') along each property line abutting the right-of-way starting at the point at which the two property lines intersect, or their projections intersect, then connecting their end points with a straight line.
   (e)    "Commercial Message" means a sign, wording or logo or other presentation that directly or indirectly names, advertises, calls or directs attention to, promotes, or offers for sale, rent or lease, a premises, business, mercantile or commercial activity, establishment, product, service, thing, theatrical performance, exhibition, event, or activity of any kind for the purpose of either directly or indirectly promoting the interest thereof.
   (f)    "Legible" means that a message can be comprehended by a person with eyesight adequate to obtain a current Ohio driver's license standing in the public way or other location from which legibility is to be determined. Where such facts are material, it will be presumed that the observation takes place in daylight hours, and that the person making the observation is standing and is between five (5) feet-two (2) inches, and six (6) feet tall.

   (g)    "Mural" means a picture or image that is painted on, applied to, or affixed to an exterior wall of a structure. A mural is only a sign if it is related by language, logo, or pictorial representation to the advertisement of any product, service, place, person, or the identification of any business.

   (h)    "Occupied Building" means a structure that is, or that may be legally used for, the shelter or enclosure of persons provided that such structure is provided with an approved comfort heating and/or cooling system, and restroom facilities.
   (i)    "Sign" means a device or area on a surface containing any words, lettering, parts of letters, figures, numerals, phrases, sentences, emblems, devices, designs, trade names or marks or combinations thereof, by which anything is made known, such as the designation of an individual, a firm, an association, a profession, a business, a commodity, product, or thing.
      (1)    "Animated sign" is a sign that is visible outdoors and includes animation or moving parts, provided that a changeable copy sign that is changed no more than one (1) time per twenty-four (24) hour period shall not be considered "animated."

      (2)   "Banner sign, horizontal" is a cloth, vinyl or other fabric sign that is affixed to poles or other stationary anchoring points and displayed so that it's longer dimension is parallel to grade.
      (3)   "Banner sign, vertical" is a cloth, vinyl or other fabric sign that is mounted vertically to brackets on a decorative light pole that is located within the City's rights-of-way.

      (4)    "Canopy sign" is a sign that is attached to, painted on, or otherwise applied to a canopy awning or other similar covered structure projecting from and attached to a building and extending beyond the building wall.
      (5)    "Changeable copy sign" is a sign that incorporates design elements that provide for changing announcements; this definition does not include an "electronic message sign" or an "animated sign".
      (6)    "Electronic message sign" is a sign that uses changing lights, light emitting diodes, or similar technology to form a message, where the sequence or copy of the message can be modified by electric or electronic processes.
      (7)    "Flashing sign" is a sign that includes intermittent-type illumination, rotating beams, beacons or illumination resembling an emergency light, provided that a changeable copy sign that is changed no more than one (1) time per twenty-four (24) hour period shall not be considered "flashing."
      (8)    "Ground sign" is a sign that is supported by one (l) or more columns, uprights or foundation walls in the ground, and that stands no higher than five (5) feet above ground level measured at its highest point above the ground.
      (9)    "Historical Plaque, Marker or Monument" is a sign not bearing a commercial message, that identifies the significance of, or that acknowledges a contribution made by a property, building, place, person, or event as it relates to the history of the community.
      (10)    "Off-premise sign" is a sign bearing a commercial message that does not pertain to the principal use of the premises.
      (11)    "Pole mounted sign" is a sign that is supported by one or more poles or pylons, the bottom of which sign is at least ten feet (l0') above ground level and not supported by the building in any way.
      (12)    "Portable sign" is a sign that is designed to be moved from one location to another.
      (13)    "Private Property Traffic Control Sign" is a sign that is erected at an entrance or exit of a premises or directly adjacent to a parking space for purposes of identifying the direction or flow of traffic or identifying or restricting a parking space in accordance with the Americans with Disabilities Act.
      (14)    "Projecting sign" is a sign that is affixed to any building structure and projects twelve inches (12") or more beyond the building wall.
      (15)    "Roof Sign" is a sign that is applied to or supported by the roof of the building or that is otherwise attached to the building so as to project above the gutter, able, or rake line of a pitched roof or the coping or roof surface of a flat roof.
      (16)    "Sign Area" is the amount of space on each display side of a sign that is contained within the smallest rectangle that may be drawn around the text and/or any graphics of a sign when such text and/or graphics are not enclosed or otherwise contained in a cabinet or frame, such as a window or canopy sign; or the amount of space contained within the frame, cabinet, or supporting structure, if so provided; or the area of the surface of the sign such as a pole sign, projecting sign, or similar sign or device.
      (17)    "Temporary Sign" is a sign made from a material or constructed in a manner such that it is intended to last only for a short, limited time and that is not permanently mounted.
      (18)    "Temporary Banner Sign" is a durable cloth or fabric sign that is affixed to a pole which pole is attached to a building by means of a bracket that is anchored into the exterior wall of the building.
      (19)    "Temporary Sandwich Board Sign" is a two-sided, self-supporting sign that is constructed of durable materials and that is placed on the ground, and typically hinged or connected at the top and not at the bottom so as to be in the general shape of the capital letter "A" when displayed.
      (20)    "Wall sign" is a sign that is attached directly to but not painted on a building
         wall and projects less than twelve inches (12") from the wall.
      (21)    "Window sign" is a sign that is affixed to a window or that is legible through a window from a location on a public right-of-way or a lot other than the one on which the sign is located.
