1183.16 BARRIERS REQUIRED TO ENCLOSE POOLS, SPAS, HOT TUBS, AND SIMILAR BODIES OF WATER.
   Wherever a swimming pool, spa, hot tub, or similar feature in excess of 24" deep is located on a property, such feature shall be enclosed by a barrier meeting the following requirements. The top of the barrier shall be a minimum of 48" above grade as measured on the side of the barrier facing away from the feature. No opening in the barrier shall exceed 2.25" in width or length except that the space between vertical members perpendicular to grade may run the full height of the barrier. All access gates shall be provided with self-closing and self-latching devices. The release mechanism shall be not less than 54" from the bottom of the gate unless it is located on the pool side of the gate, is 3" or more below the top of the gate, and the barrier contains no opening larger than .5" within 18" of the mechanism. The walls of an above ground pool shall qualify as the barrier provided they meet the requirements of this Section and provided further that the ladder is retractable and lockable in the retracted position, removable without the use of tools or special knowledge, or enclosed with a barrier meeting the provisions of this Section. Spas or hot tubs provided with a well maintained and properly fitted safety cover complying with ASTM F 1346 shall be exempt from the barrier requirements of this Section.
