1183.06 ACCESSORY BUILDINGS.
   (a)   One story accessory buildings such as garages, car ports, storage sheds, pool houses, cabanas, gazebos, decks, and other similar buildings and structures not exceeding twenty feet in height may be built within the limits of a side and/or rear yard provided they maintain a minimum setback from both the side and rear property lines of five feet.
      (1)   Attic storage is permitted in accessory buildings provided that the floor area within the rafter or truss space above the first floor level is located a minimum of ten feet from the side and rear property lines and provided further that, such storage shall not be accessible by a permanent set of stairs other than a pull down attic type stair.
       (2)   If the height of the top plate on which the rafters or trusses bear or if the height of a parapet wall exceeds twelve feet but is less than twenty feet above grade, the side and rear setbacks shall be increased to ten feet.
      (3)   Where the pitch of the roof exceeds 12/12, the side or rear setback of the walls on which the roof trusses or rafters bear, shall be increased to fifteen feet.
      (4)   If the height of the top plate on which the rafters or trusses bear or if the height of a parapet wall exceeds twenty feet but is equal to or less than thirty feet above grade, the side and rear setbacks shall be increased to fifteen feet.
   (b)   Two story accessory buildings and accessory buildings having permanent stairways accessing storage or other space above the first floor level may be built within a side or rear yard provided that they maintain a minimum setback from the side and rear property lines of fifteen feet; and further provided that they do not exceed thirty feet in height.
   (c)   The combined area of all accessory buildings and accessory structures shall not occupy more than 30% of the side or rear yard of the lot that it occupies.
   (d)   No accessory building, structure, play structure, tree house, or above grade alternative energy source equipment shall be located within the limits of a front yard.
   (e)   Any accessory building or structure that is constructed within five feet of a residence or that is attached to a residence with a roof or wall structure shall be considered to be a continuation of the residence and subject to the setback requirements thereof.

   (f)   Accessory buildings under 200 square feet (outside dimension) which do not require Building Code review under the Residential Code of Ohio shall be fixed to the ground with appropriate anchors.

   (g)   Supplemental furnaces and other buildings, enclosures, devices, or appliances intended to provide a heat or energy source to a building through the burning of solid fuel or other means that creates smoke, noise, or other condition that may be observed from the premises of others are not permitted. This section shall not apply to outdoor grills or fireplaces that are not used for home heating or energy purposes.
