The provisions of Section 903.01 shall not apply so as to require a permit for the following purposes:
(a) For the repairing of sidewalks and for the improvement of streets or other public places under or by virtue of a contract with the City;
(b) For the exercise of rights by a public utility or its duly authorized agents pursuant to a franchise granted by the City whereby the express terms of such franchise a privilege is granted contrary to the terms of this chapter; provided however, that where any such franchise is granted to a public utility to occupy the streets, alleys and other places for any purpose, such public utility or its duly authorized agents shall conform to and be subject to the terms of this chapter unless expressly exempted by the franchise.
