351.14 RESTRICTED PARKING FOR CERTAIN VEHICLES.
   (a)   No person shall park a commercial vehicle, commercial car, semitrailer, commercial truck, commercial tractor or a noncommercial truck in excess of three-quarters ton carrying capacity or having storage in its bed regardless of size for more than two hours during the period of 6:00 p.m. and 6:00 a.m. daily on the public streets in the City, unless otherwise operating under a Special Use Permit in accordance with Chapter 1188.

   (b)   For the purposes of this section:
      (1)   “Commercial car” means any motor vehicle having motive powers designed for carrying merchandise or freight or used as a commercial tractor.
      (2)   “Commercial vehicle” means any motor vehicle having motive power which may be licensed pursuant to Ohio R.C. 4503.04(E) and (H).
      (3)   “Farm truck” means any motor vehicle as defined in Section 1153.02(h)(6).
      (4)   “Noncommercial truck” means any motor vehicle having motive power licensed pursuant to Ohio R.C. 4503.04(D) and 4503.04(K) which does not come within the definition of either a commercial car or a farm truck and which is of three-fourths ton rating or less.

   (c)   Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
