Individual lots within any zoning district may be split by a simple resubdivision. A simple resubdivision provides for an adequate public record of division in a less complicated process than a major or minor subdivision. (Ord. 2008-08, 4-27-2009)
A. Review And Approval: Review and approval of simple resubdivision applications shall be completed by the administrative official of the planning and zoning commission.
B. Eligibility:
1. Eligibility of lots for the simple resubdivision process shall be determined in a preapplication conference of the administrative official and the owner or owner's representative.
2. Eligibility requirements are: (Ord. 2004-02, 3-8-2004)
a. Both lots after the split must meet the standards for size within that zoning district. (Ord. 2008-08, 4-27-2009)
b. No changes or additions to existing streets, alleys, or easements are required or proposed.
c. The proposed resubdivision shall not result in any property without direct access to a dedicated street.
d. The proposed resubdivision shall not result in any property without direct access to all existing utilities.
e. Each lot or parcel resulting from the resubdivision shall be served by its own water and sewer service tap.
C. Improvements, Reservations And Design: Simple resubdivisions shall be subject to all the requirements of chapter 6 of this title, except that the depth to front dimension ratio requirement may be waived by the administrative official. (Ord. 2004-02, 3-8-2004)
