§ 152.100 STRUCTURES LOCATED EASTWARDLY TO BE REMOVED WHEN OWNER NOTIFIED BY TOWN.
   Any structure located eastwardly of the building line shall be completely removable and the owner shall, upon written notice served by mail or in person by an official of the town, remove the structure within 48 hours of said notice for the purpose of maintenance and repair on the dune or berm section. Further, immediately upon notice in writing or in person by a police officer of the town, the owner shall remove such structures eastward of the building line during any emergency period or hurricane threat. Failure on the part of the owner to respond reasonably to such notice in either condition shall result in the town removing such structures where possible and assessing the cost thereof to the property owners or the confiscation of said structures and their disposal as the town may see fit.
