§ 92.08 TRANSPORTATION, STORAGE AND LAUNCHING OF VESSELS ON THE BEACH ADJOINING THE ATLANTIC OCEAN.
   (A)   It shall be unlawful for any person to moor, store or place any vessel, to include sailboats of any type, on any portion of the beach adjoining the Atlantic Ocean and described in division (E) below except as follows:
      (1)   Vessels owned and/or operated by employees and agents of the town, county, state or the U.S. government while engaged in official duties.
      (2)   In an emergency situation.
      (3)   Vessels registered with a race or regatta pursuant to a group activity request approved by the town in accordance with applicable town ordinances. Provided, that in no event shall such boats be placed more than 50 feet west of the high water mark or on any portion of the beach on which vegetation exists.
      (4)   Vessels not in excess of 25 feet in length and powered by sail, oar or paddle provided that in no event shall such boats be placed more than 50 feet west of the high water mark or on any portion of the beach on which vegetation exists and provided further that no such vessel shall be permitted on the beach between sunset and sunrise.
   (B)   It shall be unlawful to launch, land or transport other than by portage any vessel, to include sailboats of any type, on any portion of the beach adjoining the Atlantic Ocean and described in division (E) below except as follows:
      (1)   Vessels owned and/or operated by employees and agents of the town, county, state or the U.S. government while engaged in official duties.
      (2)   In an emergency situation.
      (3)   Vessels registered with a race or regatta pursuant to a group activity request approved by the town in accordance with applicable town ordinances. Provided, that in no event shall such boats be placed more than 50 feet west of the high water mark or on any portion of the beach on which vegetation exists.
      (4)   Vessels not exceeding 25 feet in length and powered solely by sail, paddle or oar may be transported by portage across the beach area described hereinabove.
   (C)   From April 1 through September 30, it shall be unlawful to launch or land any vessel within 200 feet of either side of an established lifeguard stand located on any portion of the beach adjoining the Atlantic Ocean and described in division (E) below except as follows:
      (1)   Vessels owned and/or operated by employees and agents of the town, county, state or the U.S. government while engaged in official duties.
      (2)   In an emergency situation.
   (D)   It shall be unlawful at any time to launch or land any vessel within 750 feet of a fishing pier located on any portion of the beach adjoining the Atlantic Ocean and described in division (E) below except as follows:
      (1)   Vessels owned and/or operated by employees and agents of the town, county, state or the U.S. government while engaged in official duties.
      (2)   In an emergency situation.
   (E)   The provisions of this section shall apply to that portion of the beach lying within the boundaries of the town adjacent to the waters of the Atlantic Ocean and described as follows:
   Seaward of the property line of the town of Wrightsville Beach as established by Chapter 246 of the Public Laws of 1939, as amended, and as shown on the map(s) of said property line maintained by the Department of Public Works of the Town of Wrightsville Beach extending to the northern terminus of said property line and then seaward of the western boundary of property of the Town of Wrightsville Beach adjoining the Atlantic Ocean as extended northwardly from said terminus; to the northern boundary of tract 7 as shown on that map entitled "North Shell Island Subdivision" and recorded in Map Book 25 at Page 20, New Hanover County Registry.
