(A) No person shall operate a personal watercraft within the waters of Kenan’s Creek at greater than no-wake speed. For purposes of this chapter, the “WATERS OF KENAN’S CREEK” shall include the waters and marshes located within that area bounded on the north by U.S. Highway 74, on the west by the Town Hall complex, on the south by Causeway Drive and on the east by Harbor island and the extension of the westernmost line of Harbor Island northwardly to its intersection with U.S. Highway 74.
(B) No person shall operate a personal watercraft within 25 feet of any marsh or shore within the following areas:
(1) Within those areas located within the town’s boundaries and the town’s extraterritorial jurisdiction lying within the following area: Bounded by the Atlantic Intracoastal Waterway to the west, the northern line of Motts Channel to the north, the eastern line of Banks Channel to the east and the northern line of Shinn Creek to the south.
(2) Within those areas located within the town’s boundaries and the town’s extraterritorial jurisdiction lying within the following area: Bounded by the Atlantic Intracoastal Waterway to the west, the southern line of the channel leading from the Atlantic Intracoastal Waterway to Mason’s Inlet extended eastwardly to the point of intersection with Highway 74 to the north, the western line of Highway 74 to the east and the southern line of Lee’s Cut and the Highway 74 bridge extending across the waters of Banks Channel to the south.
(C) No person shall operate a personal watercraft at greater than no-wake speed or at a speed that causes the personal watercraft to generate a plume of spray known as a rooster tail under either of the two bridges crossing the waters of Banks Channel (the Causeway Drive bridge and the Salisbury Street bridge) and within an area extending 100 feet to the north and 100 feet to the south of each bridge.
(D) For purposes of this chapter, a “PERSONAL WATERCRAFT” shall mean a personal watercraft as that term is defined in G.S. § 75A-13.3 or any successor statute.
