(A) The annual license fee for an on-sale license shall be established by resolution by the City Council, and all licenses shall expire on the first day of July of each year. The fee for a license granted after the commencement of the license year shall be pro-rated on a monthly basis, and each part of a month shall constitute a full month. (Ord. 652, eff. 4-13-82)
(B) All of the license fee shall be paid upon application. All fees shall be paid into the general fund of the city, and shall be paid in cash or by certified check. Upon rejection of any application for a license, or upon withdrawal of an application before approval of the issuance by the Council, the license fee shall be refunded to the applicant. Failure to pay any portion of a fee when due shall be cause for revocation.
(C) When the license is for premises where the building is not ready for occupancy, the time fixed for computation of the license fee for the initial license period shall be the date the building is ready for occupancy.
(D) No part of the fee paid for any license shall be refunded except in accordance with this section.
(E) The applicant shall pay a fee of $500 to the city for the background and financial investigation of the applicant if the investigation will take place within the state, and $10,000 if the investigation will extend outside the state.
(1) This fee shall be paid prior to the commencement of any investigation, along with the application fee.
(2) Out of the investigation fee, the city will charge the applicant the actual cost of the investigation, which is non-refundable, and will return any unused balance of the fee to the applicant, whether or not the application is denied.
(F) At any time that an additional investigation is required because of a change in the ownership or control of a corporation or because of an enlargement, alteration, or extension of premises previously licensed, the licensee shall pay an additional non-refundable investigating fee in the amount of $500. Where a new application is filed as a result of incorporation by an existing licensee and the ownership control and interest in the license are unchanged, no additional license fee will be required.
(G) No part of the fee paid for any license issued under this section shall be refunded except in the following instances upon application to the Council within 30 days from the happening of the event. The Council may in its judgment refund a pro-rata portion of the fee for the unexpired period of the license, computed on a monthly basis, when operation of the licensed business ceased because of:
(1) Destruction or damage of the licensed premises by fire or other catastrophe.
(2) The licensee's death.
