§ 92.99 PENALTY.
   In addition to any other remedies that may be available to the city, including the right to maintain an action in any court of record for the prevention, restraining, abatement or enjoining of any public nuisance, the city may enforce the terms of this chapter by criminal prosecution, for which the following penalties shall apply upon conviction:
   (A)   First offense within 12 month period. Any person convicted of violating any provision of this chapter for the first time within the previous 12 months shall be fined by the Court in an amount not to exceed $200, and/or in addition to the payment of restitution and the performance of community service as deemed necessary by the Court.
   (B)   Second or subsequent offense within 12 month period. Any person convicted of violating any provision of this chapter for a second or greater time within the previous 12 months shall be punished by a fine not to exceed $700 or imprisonment for not more than 90 days, or both, plus the costs of prosecution in either case.
