§ 51.11  STORM SEWER MAINTENANCE.
   (A)   Title. This section shall be called the “Storm Sewer Maintenance Ordinance.”
   (B)   Purpose. The purpose of this section is to protect the integrity of the storm sewer system from damage caused by the depositing of any form of organic or nonorganic materials into the storm sewer system.
   (C)   Prohibition against the obstruction of storm drains. It shall be unlawful for any person to cause grass-clippings, leaves, sticks, trash, and other materials or debris to be deposited in or on the curbs and public streets of the town, or in any manner to obstruct the storm sewer system of the town.
   (D)   Leaf collection requirements. All property owners who desire to avail themselves of the town’s leaf collection services shall insure that leaves are placed off of the public streets and curbs and on the owner's property. Any person who places leaves for collection on the curbs or public streets is in violation of this section.
   (E)   Penalty. Any person who violates this section may be fined a civil penalty of $50. Each day the violation exists shall be deemed to be a separate violation.
   (F)   Other remedies; attorney fees and costs. In addition to the fines imposed under this section, the town shall be entitled to all other remedies available in equity and at law, including injunctive relief. Further, any person who violates this section shall be liable for reasonable attorney fees as well as any damages incurred by the town in abating the obstruction of the storm sewer system.
   (G)   Enforcement. The provisions of Chapter 34 of this code shall apply to violations of this section.
