(A) Any person desiring to erect or construct an encroachment structure or desiring to maintain an existing encroachment structure upon public property must first obtain an encroachment permit therefor. An encroachment permit may be obtained by filing a written application with the Clerk-Treasurer on a form supplied through the office of the Clerk-Treasurer.
(B) The application shall state the name and address of the owner of the adjacent real property description of the adjacent real properly benefitted by the encroachment, a one-sheet plot plan illustrating the proposed structure, and a written justification as to the need for the encroachment.
