331.36 UNNECESSARY NOISE; SQUEALING TIRES AND RACING THE MOTOR.
   (a)   No person shall disturb the peace and quiet of the City by making unnecessary noise in the operation of a motor vehicle or motorcycle by any of the following:
      (1)   By the squealing of tires on the pavement, through unnecessarily rapid acceleration, deceleration or abrupt turns with a vehicle.
      (2)   By racing the motor vehicle, so as to cause an unnecessarily loud noise to be emitted from the exhaust system, regardless of the type of exhaust system.
      (3)   By creating any other noise in the operation of a vehicle which is not necessary to the normal operation of such vehicle.

   (b)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
