713.06 SOLICITATION IN ROADWAY PROHIBITED WITHOUT PERMIT.
   (a)   Permit. No person or entity, without having first obtained a Roadway Solicitation Permit from the Director of Public Safety, shall solicit or cause to be solicited contributions from the driver or occupants of a vehicle on any street, highway or traveled portion of the roadway.
   (b)   Charitable Organizations/Governmental Entities. Only charitable organizations declared to be tax-exempt under Section 501(c)(3) of the Internal Revenue Code, as amended, and local governmental entities may be issued a Roadway Solicitation Permit.
   (c)   Application/Regulations. Prior to issuing a Roadway Solicitation Permit, the Director of Public Safety shall review completed applications for compliance with this Chapter and the following regulations:
      (1)   Roadway solicitation may only occur between the hours of 8:00 a.m. and 5:00 p.m. local time. In addition, no roadway solicitations shall occur Monday through Friday 8:00 a.m. – 8:30 a.m.; 11:30 a.m. – 1:30 p.m.; and 4:30 p.m. – 5:00 p.m.
      (2)   A Roadway Solicitation Permit will not be issued to the same or any affiliated organization more than one time in each calendar year and the permit shall not be issued for more than one day each calendar year.
      (3)   A Roadway Solicitation Permit shall specify not more than two intersections where such solicitation may take place; a copy of the application form containing a list of the names and addresses of all persons authorized to solicit on behalf of the organization shall be appended to the Roadway Solicitation Permit.
      (4)   No person under the age of eighteen (18) shall conduct such solicitation.
      (5)   A waiver of liability statement, releasing the City of Worthington from liability for any and all claims, of every kind and description, that may arise from a person’s solicitation within the City of Worthington must be signed by each person soliciting on behalf of a charitable organization or governmental entity, and shall accompany each application for a Roadway Solicitation Permit.
      (6)   Only one charitable organization or local governmental entity shall be permitted to solicit on the same date and then only when the Director of Public Safety determines that such solicitation would not cause excessive traffic congestion or hazard and does not conflict with a previously scheduled parade or other public event.
      (7)   Persons soliciting contributions pursuant to this Chapter shall have a copy of the Roadway Solicitation Permit with them at all times during the period of solicitation and shall display it upon request.
      (8)   All persons soliciting contributions pursuant to a Roadway Solicitation Permit shall wear bright colored clothing and/or safety vests and shall prominently display an organization identification.
      (9)   In determining whether to issue a Roadway Solicitation Permit, the Director of Public Safety may require an organization to provide evidence of a paid- up liability insurance policy or certificate of insurance in the amount of not less than one million dollars ($1,000,000) which insures the organization for any and all claims that may arise as a result of soliciting contributions pursuant to a Roadway Solicitation Permit. In addition, such policy of insurance shall name the City and its officers, agents, and employees as “Additional Insureds” under such policy. Governmental entities shall not be required to provide evidence of such insurance.
   (d)   Revocation. The Director of Public Safety shall have the authority to revoke or temporarily suspend a Roadway Solicitation Permit if conditions are, in his or her opinion, sufficiently hazardous as to require such revocation or suspension.
