903.10 SIDEWALKS ON IMPROVED STREETS.
   Sidewalks shall be constructed on existing improved streets at such time as Council determines the necessity of sidewalks or the property owners petition Council for sidewalks. In determining the necessity for sidewalks, Council may consider the following:
   (a)   The use of the street as a connector street, as identified by various available maps such as:
      (1)    The Thoroughfare Map, which was adopted by the Planning Commission on 2/25/81, which shows major streets and collector streets;
      (2)    The City Urban Area Map which identifies principal arterial, minor arterial and collector streets, which are the approved functionally classified and federal aid routes. (Developed in 1975).
      (3)   The Permissive Tax Street System Map, developed in June 1984, which identifies those streets which are important for movement of traffic and which qualify for permissive tax funds.
   (b)   The streets, proximity to schools, parks, business districts, public and semi-public buildings and other places which attract much pedestrian traffic.
   (c)    The street's location with relation to existing and potential vehicular and pedestrian traffic.
   (d)    The need to connect areas with existing sidewalks so as to provide safe walkways for pedestrian traffic between various parts of the City.
   (e)   Upon determination by City Council of the necessity for sidewalks based on subsection (a) hereof, the Engineer shall, pursuant to Ohio R.C. 729.01 to 729.05, prepare plans, specifications and cost estimates for the necessary sidewalk repairs or replacements. These shall then be reported to Council which shall proceed according to the above statutes to give notice to the owners of abutting property to repair or replace the sidewalks as required by resolution of Council. If the property owners fail to repair or replace the sidewalks as required by resolution of Council, the City shall proceed, pursuant to Ohio R.C. 729.01 to 729.05, and repair or replace the sidewalks and assess the costs against the lots or lands abutting thereon.
