110.01 DISPOSITION OF SURPLUS MUNICIPAL AND HOSPITAL PERSONAL PROPERTY.
   The Director of Administration, or in the case of the hospital, the Administrator, is hereby granted the authority and responsibility to provide for the orderly disposition of surplus municipal or hospital personal property. This authority shall be exercised in the following manner:
   The Director of Administration, or in the case of the hospital, the Administrator, is hereby granted the authority and responsibility to provide for the orderly disposition of surplus municipal or hospital personal property. This authority shall be exercised in the following manner:
   (a)   The Director of Administration or the Administrator shall periodically prepare an itemized list of surplus municipal or hospital personal property which is no longer useful or necessary for any current municipal or hospital purpose. The list shall be in such form so as to separately list all items determined by the designated official to have a fair market value of more than ten thousand dollars ($10,000), and all items determined by him/her to have a fair market value of ten thousand dollars ($10,000) or less.
   (b)   For those items on the surplus property list that have been determined to have a fair market value of ten thousand dollars ($10,000) or less, s/he shall dispose of the property upon such terms and conditions as s/he shall deem to be appropriate and in the best interests of the City.
   (c)   For those items on the surplus property list that have been determined to have a fair market value of more than ten thousand dollars ($10,000), s/he shall submit a list of items to be disposed of to City Council or the hospital Board of Governors for approval by ordinance, and the items shall be disposed of in one of the following ways:
      (1)   Sealed bids after advertising at least one time in a newspaper of general circulation in the City.
      (2)   Public auction after advertising at least one time in a newspaper of general circulation in the City.
      (3)   By electronic auction by posting on a website maintained by the City or the hospital and accessible to the general public; or by posting on a commercial or governmental website recommended by the Director of Administration or Hospital Administrator.
   (d)   If, during preparation of the surplus personal property list, the designated official determines that certain personal property has no value (for example, fixed assets which have exceeded their useful life and have been fully depreciated), s/he is authorized to cause such property to be properly disposed of or sold as scrap.
   (e)   The designated official may sell, trade or donate surplus property to another governmental, hospital or health care agency or a not-for-profit agency located within and serving, at least in part, the City of Wooster, without the necessity of advertising, bids or auction sale, pursuant to the following procedure:
      (1)   S/he shall notify City Council or the Hospital Board of Governors of the property to be sold or traded, its estimated fair market value, and the consideration to be received for the property.
      (2)   If the estimated fair market value of the property is greater than ten thousand dollars ($10,000), City Council or the Hospital Board of Governors must approve the transaction by ordinance or resolution. If the estimated fair market value of the property is ten thousand dollars ($10,000) or less, City Council or the Hospital Board of Governors may approve the transaction by motion.
