160.011 ADVERTISING AND AWARDING OF BIDS; SINGLE OR MULTIPLE CONTRACTS.
   (a)   Notwithstanding the provisions of Ohio R.C. 153.50 to 153.52, Council hereby authorizes the Director of Administration or the Administrator of Wooster Community Hospital to determine which contracts for construction, alteration, expansion, repair, restoration, rehabilitation or remodeling of a public work or improvement shall be bid or awarded on a single contract basis, thereby making the successful bidder a prime or general contractor who shall be responsible for completing and supervising the entire public work or improvement, and which contracts for construction, alteration, repair, restoration, rehabilitation, expansion or remodeling of a public work and improvement shall be bid or awarded using separate and distinct contracts for each trade or kind of mechanical labor, employment or business involved in the work or improvement.
   In making the determination as to whether a public work or improvement contract should be bid or awarded as a lump sum contract or through the use of separate and distinct trade contracts, the Director of Administration or the Administrator of Wooster Community Hospital shall consider the following:
      (1)   The recommendation, if any, of the manager of the department or division involved in the public work or improvement;
      (2)   The recommendation, if any, of the Director of Finance on the most financially advantageous manner of bidding the public work or improvement;
      (3)   Any time constraints which the project may face; the experience of the City in the construction of similar public works or improvements in the past using lump sum or multiple contracts; and
      (4)   Any advantages and disadvantages which the particular public work or improvement may pose dependent upon whether a lump sum or multiple contract bidding process is used.
   (b)   Notwithstanding the provisions of Ohio R.C. 153.12(A), which requires the public owner to disclose its own estimate of the cost of the work being competitively bid in the project plans and specifications, Council hereby authorizes the Director of Administration or the Administrator of Wooster Community Hospital to determine which bids for construction, alteration, expansion, repair, restoration, rehabilitation or remodeling of a public work or improvement shall include the City’s own estimate of the cost of the work to be performed and which contracts shall not include such an estimate. In making this decision, the Director of Administration or the Administrator of Wooster Community Hospital shall consider the recommendations of the manager of the department or division involved in the public work or improvement, or the recommendation of the Director of Finance on the advisability of including the City’s own cost estimates with the plans and specifications for the work to be performed.
