947.99 PENALTY.

   Should it be found, after conducting the hearing and appeal procedure provided for in Section 947.08 (d), (e) and (f), that the Grantee is in violation of the terms of this chapter, the penalties chargeable shall be as follows:

   (a)    For failure to complete construction and installation of the system or provide service in accordance with this chapter or to remove facilities and equipment as required in Section 947.15, Grantee shall forfeit five hundred dollars ($500.00) per day or part thereof that the violation continues unless Council specifically approves the exception by resolution.

   (b)    For failure to provide or maintain data and reports as requested by the City or as required in Sections 947.07, 947.13 and 947.18. Grantee shall forfeit one hundred dollars ($100.00) per day or part thereof that the violation continues after notification by the City.

   (c)    For failure to comply with the operational standards following the Council's resolution directing Grantee to make improvements pursuant to Section 947. 12, Grantee shall forfeit two hundred dollars ($200.00) per day or part thereof that the violation continues

   (d)    For failure to comply with the terms and conditions of Section 947.13, Grantee shall forfeit one hundred dollars ($100.00) per day or part thereof that the violation continues.

   (e)    For failure to pay the franchise fee when due pursuant to Section 947.07, Grantee shall forfeit one hundred dollars ($100.00) per day or part thereof that the violation continues.

   (f)    For persistent failure to comply with such reasonable requests and recommendations as may be made by the City pursuant to authority granted by this chapter, Grantee shall forfeit one hundred dollars ($100.00) per day or part thereof that the violation continues.
