PENDING ORDINANCES
ORDINANCE NO. 1694
AN ORDINANCE AMENDING SECTION 52.14, “WATER”, OF THE CODE OF ORDINANCES OF THE CITY OF WOODWARD, OKLAHOMA, ESTABLISHING WATER METER TESTING FEES AND ESTABLISHING CHARGES FOR DAMAGE TO AUTOMATED METER READING EQUIPMENT; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF WOODWARD, OKLAHOMA:
 
That Section 52.14 is amended as follows:
 
52.14:   METERS
 
A.    [No Changes]
 
B.   Where accuracy of record of a water meter is questioned, it shall be removed at the customer’s written request, and shall be sent to a testing facility certified to test water meters pursuant to the American Water Works Standards (now in existence and as modified from time to time).in his presence be tested in the shops of the Water Department by means of the apparatus there provided, and a report thereon duly made.  Both parties to the test must accept the finding so made.  Upon the city’s receipt of the certified testing results/report, the same shall be provided to the customer.  If the testing results/report discloses an error against the customer consumer of more than 3% in the meter’s registry, the excess of the consumption on the three (3) previous readings shall be credited to the customer’s account and the water department shall bear the entire expense of the test and the deposit required as hereinafter prescribed shall be returned.  On the other hand, where no such error is found, the person who has required the test shall pay the charge for such test, and all related expenses including postage/freight to and from the testing facility.  Before making a test of any meter, the person requesting such test shall, at the time of filing his request with the water superintendent, make a deposit with the city clerk in the amount charged for such test subject to the conditions herein stated, which charges are fixed as follows:
 
   For testing 1/2-inch to 1-inch meters         $42.50 $150.00
   For testing 1 ½-inch to 2-inch meters         $67.80$400.00
   For testing any meters larger than 2 inches      $143.85
For testing 3-inch to 4-inch meters         $700.00
For testing 6-inch meters            $1,000.00
For testing 8-inch meters            $1,200.00
For testing 10-inch meters            $1,400.00

D.    [No Changes]
 
E.   No person shall damage or destroy any part of the automated meter reading system. Damage to any part of the meter reading system will be charged to the customer as follows:
 
Sensus Mushroom Cap            $30.00
   Transmitter                  $155.00
Service Call Fee (after hours & weekends)      $50.00
         
SEVERABILITY.  The provisions hereof are declared to be severable, and if any section, paragraph, sentence or clause of this Ordinance is for any reason held invalid or inoperative by any court of competent jurisdiction such decision shall not affect any other section, paragraph, sentence or clause thereof.
 
EMERGENCY.  Whereas it is immediately necessary for the preservation of the public peace, health, and safety of the City of Woodward, and the inhabitants thereof that the provisions of this Ordinance become operative immediately, an emergency is hereby declared to exist, and this Ordinance shall be in full force and effect immediately from and after its passage, approval, and publication as provided by law.
