135.10 CREDIT/DEBIT CARD PAYMENT POLICY.
   (a)   Any person making payment of utility bills, fines, special assessments, or other monies due to the Village may make such payment by means of a credit or debit card, provided, that, in addition to such payments the person shall pay a convenience or transaction fee in an amount as determined by the vendor providing the Village with the transaction device.
   (b)   All persons shall be informed at the time of the transaction of the convenience or transactions fee amount and said amount shall be paid directly to the vendor rather than the Village, and the Village shall not assess any additional transaction or convenience fees.
   (c)   Acceptance of a credit or debit card as a form of payment shall be in accordance with the rules and regulations of the credit or debit card provider.
   (d)   No person making any payment by credit or debit card to the Village shall be relieved from liability for the payment obligation except to the extent that the Village realizes final payment of the payment obligation in cash or its equivalent, provided, however, if final payment is not made by the Credit/Debit Card issuer or other guarantor of payment in the transaction, then the underlying obligation shall survive and the Village shall retain all remedies for enforcement that would have applied if the transaction had not occurred.
