1103.02 DEFINITIONS.
   Words, phrases, and terms defined in this Planning and Zoning Code shall be given the defined meaning as set forth below. Words, phrases, and terms not defined in this Code shall be given their usual and customary meanings with except where the context clearly indicates a different meaning.
   (a)    Labels and titles pertaining to Woodsfield include:
      (1)    “Village” shall mean the Village of Woodsfield, Ohio.
      (2)    “Council” shall mean the Village Council of Woodsfield.
      (3)    “County” shall mean Monroe County, Ohio.
      (4)   “Solicitor” shall mean the legal advisor to the Village.
      (5)   “Village Administrator” shall mean the village administrator of the Village of Woodsfield.
      (6)    The phrase “Planning and Zoning Code” or “this Code” includes all ordinances amending, explaining or supplementing the same.
   (b)    Words with specific defined meaning are as follows:
      Abandon. A failure to maintain, use or occupy a building, use, structure or motor vehicle for a period of time.
      Access Drive. Any connection to a street that permits access to or from street by vehicles, cars, trucks, buses, bicycles, pedestrians or motorcycles, for the purpose of accessing the street.
      Accessory Building. A subordinate building detached from, but located on the same lot as, the principal or main building, the use of which is customarily incidental to the principal building or use and which is constructed subsequent to the principal building or principal use of the land, such as but not limited to a detached garage, storage shed, etc.
      Accessory Use. A use located on the same zoning lot with the principal or main use of a building, other structure or land, but incidental to the main building or land use.
   
      Agriculture. Any agricultural use such as and including, but not limited to, farming, dairying, pasturage, animal and poultry husbandry, growing crops, horticulture, floriculture, viticulture and greenhouses, but excluding kennels, stockyards, and slaughter houses.
      Apartment Unit. An individual dwelling unit within a multi-family building or located above the first floor of a commercial building.
      Applicant. The owner of the land proposed for application of a zoning permit, or his representative. The authority of the representative shall be established to the satisfaction of the Village Council. Application. A formal submission by an applicant to obtain permits or approval pursuant to this Planning and Zoning Code and in such form and containing information, plans and specifications as required by this code.
      Assembly Hall, Meeting Place. An establishment providing meeting space for social gatherings, including but not limited to wedding receptions, graduations parties and business or retirement functions. This term includes, but is not limited to, a banquet hall or rental hall.
      Basement Or Cellar. That portion of a building between floor and ceiling which is wholly or partly below grade and having more than one-half (1/2) of its height below grade.
      Block Frontage. All the property on one side of a street, between two streets which intersect such street or for a distance of 500 feet on either side of an existing or proposed building or structure, measured along the line of the street, or if the street is dead ended, then all of the properties abutting on one side between an intersecting street and the dead end of the street, but not including properties more than 500 feet distant on either side of an existing or proposed building or structure.
      Buffer. A naturally vegetated area or vegetated area along the exterior boundaries of an entire development processed in accordance with a subdivision application that is landscaped and maintained as an open space or conservation area in order to eliminate or minimize conflicts between such development and adjacent uses.
      Building Line. Establishing a line the width of the lot, parallel with the frontage, at the nearest point of the principal building.
      Building, Accessory Building. Any structure, designed or built for the support, enclosure, shelter, or protection of persons, animals, chattels or property of any kind.
      Business. An occupation, employment, or enterprise that occupies time, attention, labor and materials, wherein merchandise is exhibited or sold, or where services are offered or provided.
      Car Wash Establishment. The use of a site for washing and cleaning of passenger vehicles, recreational vehicles, or other light duty equipment.
      Carport. A completely covered automobile parking space not completely enclosed by walls or doors.
      Cemetery. The land used or intended to be used for the burial of human or animal dead.
      Club. A building or portion thereof or premises owned or operated by a corporation, association, person, or persons for a social, educational or recreational purpose, but not primarily for profit or to render a service which is customarily carried on as a business.
      Commercial Recreation, Indoor. A facility primarily used for the indoor conduct of, or participation in, recreational activities, and secondarily for the viewing of such activities. This term includes, but is not limited to, an indoor driving range, volleyball court, bowling alley, ice or roller skating rink, billiard hall, video game center, archery or shooting range, soccer field or basketball court.
      Commercial Recreation, Outdoor. Any outdoor commercial activity that is related to the sports industry such as outdoor commercial swimming pools, miniature golf, golf courses, driving ranges, archery or shooting range, soccer field, volleyball court, basketball court and similar activities.
      Conditional Use Zoning Permit. A permit granted by the Village Council and thereafter issued by the Village Administrator for the use of land, buildings, and other structures not otherwise permitted in any zoning district under conditions and stipulations set forth in this Planning and Zoning Code.
      Conditional Use. An uncommon, unique or infrequent use which shall not be permitted by right but may be permitted in certain districts under specific conditions after the issuance of a conditional use permit by the Village Council after making a determination for conformance with the procedures and standards established in this Planning and Zoning Code.
      Corner Lot. See Lot, Corner.
      Crematory. A facility at which a cremation chamber is located and the cremation process takes place. It does not include an infectious waste incarceration facility or a solid waste incineration facility.
      Cultural Institutions. Public or private facilities used for display, performance, or enjoyment of heritage, history, or the arts. This use includes, but is not limited to, museums, libraries, art performance venues, cultural centers, and interpretative sites but does not include movie theaters.
      Day Care Center (adult or child). A facility operated for the purpose of providing care, protection, and guidance to individuals during part of a 24-hour day. This term includes nursery schools, preschools, adult day care centers, child day care centers, or other similar uses. Day care center does not include public or private educational facilities or any facility offering care to individuals for a full 24-hour period.
      Distribution Facilities. Facilities in enclosed buildings primarily engaged in the sale or distribution of goods and materials in large quantity to retailers or other businesses for resale to individual or business customers. This shall not include heavy manufacturing, resource extraction, bulk storage of hazardous materials, or scrap or salvage operations.
      District. See definition of zoning district.
      Drive-Through Facilities. An establishment that enables customers to receive services, or obtain goods while remaining in their motor vehicles.
      Driveway. A private way, other than a street or alley, that provides access from a street or alley to one lot of record for the use of vehicles unless approval has been granted for a shared driveway.
      Dwelling Unit. A single unit of one or more rooms comprising complete, independent living facilities for living, dining, sleeping room or rooms, storage closets, as well as space and equipment for cooking, bathing and toilet facilities, all used by only one (1) family or one housekeeping unit. A dwelling unit shall not include a mobile home or recreational vehicle, camping equipment, or a manufactured home except for permanently sited manufactured homes that conform to the requirements for such structures.
      Dwelling, Multi-family. A dwelling designed for residential occupancy other than as a one-family dwelling or a two-family dwelling. The term "multiple dwelling" shall include apartment houses, row houses, and townhouses; but shall not include motels or hotels.
      Dwelling, One-family. A detached building designed for and to be occupied exclusively by one family which has the main entrance to its living quarters at ground level.
      Dwelling, Two-family. A detached building designed for or occupied exclusively as a residence for two families.
      Dwelling. Any building, or portion thereof, that is designed for or used for residential purposes, including one-family, two-family, and multi-family dwellings, but not including hotels, motels, tents, recreational vehicle, cabins, or boarding houses.
      Easement. Written authorization by a property owner for the use by another person of a designated part of such owner's property for a specified purpose.
      Essential services. The erection, construction, alteration or maintenance by public utilities or municipal or other governmental agencies, of underground or overhead gas, electrical, steam or water transmission or distribution systems, collection, communication, supply or disposal systems, including poles, wires, drains, sewers, pipes, conduits, cables, fire alarm boxes, police call boxes, traffic signals, hydrants and other similar equipment and accessories in connection therewith reasonably necessary for the furnishing of adequate service by such public utilities or municipal or other governmental agencies or for the public health, safety and welfare, but not including buildings other than structures for the purpose of housing the essential services named herein.
      Family. One individual, any number of individuals related by blood, adoption or marriage plus no more than two (2) unrelated individuals, or not more than four (4) unrelated individuals occupying a single dwelling unit and living as a single housekeeping unit, but not including groups occupying a hotel or motel as herein defined.
      Fence. Steel, chain, mesh, wood, plastic, or vegetative barrier or divider.
      Financial Institution. Banks, savings and loan associations, mortgage companies, credit unions and small loan companies.
      Finished Grade. The mean elevation of the finished surface of the ground adjoining the building or structure within a distance of ten feet of the foundation wall.
      Fleet Vehicle. A group of cars, trucks, vans, and/or other vehicles, including motorized equipment, owned or leased by a business, government agency or other organization, and which is used as part of the entityfs operations, but not including a privately owned customer or employee vehicle.
      Floor Area. The sum of the gross horizontal area of the several floors or levels of a dwelling normally used for family occupancy, excluding basements, workshops, garages, terraces, breezeways, carports, decks, attics, porches, business service area and clubs. Floor area for nonresidential buildings shall mean the gross horizontal area, measured from the exterior faces of a structure, and excluding any area utilized as a dwelling.
      Frontage, Street. The width of contiguous land between property lines abutting upon a dedicated and accepted road or right-of-way. On a corner lot, the frontage is measure along the lot line abutting the street having the longest block frontage.
      Funeral Home. A building or part thereof used for human funeral services, and which may contain space and facilities for: (a) embalming and the performance of other services used in preparation of the dead for burial; (b) the performance of autopsies and other surgical procedures; (c) the storage of caskets, funeral urns, and other related funeral supplies; (d) the storage of funeral vehicles; and (f) a funeral chapel. A funeral home may include a crematory facility.
      Garage. An accessory building primarily intended for and used for the enclosed storage or shelter of private motor vehicles of the owner or occupant of the principal building.
      Gasoline Station. Establishments that sell unleaded and diesel gasoline along with other automotive fuels.
      General Offices (Administrative, Professional, Business). Establishments providing executive, management, administrative, or professional services including, but not limited to, real estate, architecture, legal, travel, employment, advertising, design, engineering, accounting, and similar uses.
      Grade Finished. The elevation of the surface of the ground of any parcel of land after construction of buildings, parking, driveways, streets, the completion of all landscaping and all other improvements.
      Grade, Natural. The elevation of the natural, undisturbed surface of the land.
      Grade, Street. The centerline elevations and gradient of the proposed street.
      Grading. The excavating, filling, or stockpiling of earth material, or any combination thereof, including the land in its excavated or filled condition.
      Height, Building. The vertical distance measured from the average elevation of the finished grade at the front of the building to the highest point of the coping in the case of a flat roof, and to the mean height between the eaves and ridge in the case of a pitched roof.
      Height, Structure Other Than A Building. The vertical distance measured from the finished grade to the highest point of the structure.
      Home Occupation. An occupation or profession for financial gain or profit carried on within a dwelling unit by resident occupants of such dwelling unit and which occupation is clearly incidental and secondary to the residential use of the property.
      Hotel and Motel. A building or part thereof, containing six or more guest rooms where lodging is provided and offered to the public for compensation on a daily rate and which is open to occupancy for periods of less than thirty (30) days.
      Housekeeping Unit. Not more than four unrelated persons occupying a dwelling unit and living as a single group, and with communal cooking on the premises as distinguished from a group occupying a boarding house, hotel, or motel. See also Family.
      Industrial Assembly. The business of fitting together of manufactured parts into a marketed product where there are no polluting by-products.
      Industrial Fabrication. The business of forming, shaping, or constructing manufactured parts into an item where by-products are limited to sections or drop-off/cuttings from the item.
      Institution. A building occupied by a non-profit corporation or a non-profit establishment for public use.
      Institutional Housing. Housing for the elderly or infirm in which three or more unrelated individuals may live on a short-term or long-term basis and where both food and care are provided for compensation. Institutional housing includes, but is not limited to elderly housing, nursing homes, assisted living facilities, and hospices. Institutional housing shall not include hospitals, medical offices/clinics, or similar institutions devoted primarily to the diagnosis and treatment of the sick or injured.
      Instructional Studios. An establishment that provides educational programs, workshops, or classes in art or health and fitness, including but not limited to, art studios, dance studios, photography studios, health centers, etc.
      Junk yard. Any building and/or open space where waste or discarded materials are stored, processed or sold.
      Junk. Dismantled or wrecked automobiles or parts thereof, or inoperable vehicles old or scrap copper, brass, rope, rags, batteries, paper, rubber, iron or steel and other scrap.
      Kennel, Commercial. Any lot or premises on which four (4) or more domesticated animals of more than four (4) months of age are housed, groomed, bred, boarded, trained or sold and which may offer provisions for minor medical treatment.
      Laboratories. A building or part thereof in which are located facilities for scientific research, investigation, testing, or experimentation, but not facilities for the manufacture or sale of products except as incidental to the main purpose of the laboratory.
      Landscaping. The aesthetic improvement of property through the installation of plant materials, berming, walls and fences, and other decorative features, composed mostly of green/living vegetation.
      Loading Space (Loading Dock). A space within the main building or on the same lot therewith providing for the standing, loading or unloading of trucks. All off-street loading spaces shall be located totally outside of any street or alley right-of-way.
      Lot Line, Front. The front property line, which is coterminous with the street right-of-way. A front lot line is generally parallel to or less than 45 degrees to the rear lot line. The front lot line is generally opposite the rear lot line. On a corner lot, the front lot line shall be the lot line abutting the street having the longest block frontage.
      Lot Line, Rear. A lot line opposite a front yard. A rear lot line is generally parallel to or less than 45 degrees to the street right-of-way line.
      Lot Line, Side. A lot line generally extending perpendicular to the front lot line, and extending between the front lot line and the rear lot line.
      Lot Line. The boundary of a lot that separates it from adjoining lots, public land, private land, common, public, or private open space, and public or private roads.
      Lot Width. The width of a lot at the building setback line measured at right angles to its depth.
      Lot, Corner. A lot abutting upon two (2) or more streets at their intersection.
      Lot, Double Frontage. A lot having a frontage on two (2) non-intersecting streets as distinguished from a corner lot.
      Lot, Interior. A lot that has a single street frontage, a rear lot line, and at least two side lot lines.
      Lot Area. The area of a lot computed exclusive of any portion of the right of way of any public thoroughfare.
      Lot, Nonconforming. See Nonconforming Lot.
      Lot. A parcel of land of sufficient size to meet minimum zoning requirements for use, coverage, and area, and to provide such yards and other open spaces as are herein required.
      Manufactured Home. A building unit or assembly of closed construction that is fabricated in an off-site facility and constructed in conformance with the Federal Construction and Safety Standards established by the Secretary of Housing and Urban Development pursuant to the Manufactured Housing Construction and Safety Standards Act of 1974, 88 Stat. 700, 42 U.S.C.A. 5401, 5403 and that has a permanent label or tag affixed to it, as specified in 42 U.S.C.A. 5415, certifying compliance with all applicable Federal construction and safety standards.
      Medical And Dental Offices Or Clinics. Office or clinic uses concerned with the diagnosis, treatment, and care of human beings related to medicine or dental. This definition does not include hospitals or institutional homes.
      Mobile Home. A building unit or assembly of closed construction that is fabricated in an offsite facility, is more than thirty-five (35) body feet in length or, when erected on site, is three hundred and twenty (320) or more square feet, is built on a permanent chassis, is transportable in one or more sections, and does not qualify as a Manufactured Home as defined in this Zoning Code.
      Motor Vehicle Sales. A building and lot used for the display and sale of new motor vehicles where repair service and sales of operable used motor vehicles may be an incidental accessory use.
      Motor Vehicle. Any vehicle that is propelled or drawn by power other than muscular power or power collected from overhead electric trolley wires.
      Nonconforming Building or Structure. Any structure, lawfully designed and constructed prior to the enactment of this Planning and Zoning Code or any amendment hereto, which does not now comply with all of the regulations of this Planning and Zoning Code or of any amendment hereto governing bulk for the zoning district in which such structure is located.
      Nonconforming Site Condition. Any site development condition such as number and setback of parking spaces, and sign dimensions existing lawfully at the time this Planning and Zoning Code, or an amendment thereto became effective but which does not conform to the site development requirements of the district in which it is located.
      Nonconforming Use. The use of a building or land existing lawfully at the time this Planning and Zoning Code, or an amendment thereto became effective but which does not conform to the main or accessory use regulations of the district in which it is located.
      Off-Street Parking Space. Any parking space located wholly off any street, alley or sidewalk, either in an enclosed building or on an open lot.
      Outdoor Dining Area. Dining out of doors as an accessory use to an indoor restaurant where patrons may be served food and beverage for on-site dining.
      Outdoor Display And Sales. The placement of products or materials for sale outside of a retail or wholesale sales establishment.
      Outdoor Storage. The storage of goods, materials, merchandise or vehicles in an area outside of a building or structure in the same place for more than 24 hours.
      Owner. A person recorded as such on official records and including duly authorized agent or notary, a purchaser, devisee, judiciary; and person having a vested or contingent interest in the property in question
      Parking Aisle. The driveway or access drive by which a car enters and departs a parking space.
      Parking Lot. A surface level facility providing vehicular parking spaces along with adequate drives and aisle, for maneuvering, so as to provide access for entrance and exit for the parking of more than two vehicles.
      Parking Space. A designated area within a parking lot that is designed for the parking and placement of one (1) motor vehicle exclusive of drives, aisles or entrances giving access thereto.
      Permanently Sited Manufactured Home. A manufactured home that meets all of the criteria set forth in Chapter 1125.
      Person. An individual, firm, partnership, corporation, company or association.
      Personal Service Establishments. Any enterprise conducted for gain that is primarily offering services to the general public such as shoe repair, laundry and dry-cleaning services, watch repair, barber shops, beauty parlors and related activities.
      Places Of Worship, Church. Structures and other indoor or outdoor facilities used for public worship and related educational, cultural, and social activities.
      Public Hearing. A public proceeding held by the Village Council proceeded by published notice and the public is invited to attend and be heard.
      Public Meeting. A meeting of the Village Council proceeded by notice, open to the public and at which the public may, at the discretion of the body holding the public meeting, be heard.
      Public Safety And Service Facilities. Facilities operated by public agencies for the protection of the public, or the provision of governmental services, that may include, but are not limited to, fire stations and other firefighting facilities, sheriff and police stations, public works departments, village or county offices, and emergency medical service facilities.
      Recreational Vehicle. A vehicular portable structure that is designed and constructed to be used as a temporary dwelling for travel, recreational and vacation uses and includes travel trailers, motor homes, pick-up campers, motorized homes, folding tent trailers and similar vehicles.
      Research And Development Facilities. An establishment or facility for carrying on investigation in the natural, physical, or social sciences, or engineering and development as an extension of investigation with the objective of creating end products.
      Restaurant. A retail service establishment wherein the entire or substantially all of the business activity consists of food for consumption within the building.
      Retail Establishment. Establishments primarily engaged in the sale of goods and materials to the general public. Retail commercial uses may include, but are not limited to, bookstores, antique stores, convenience stores, bakeries, grocery stores, and other similar uses. This term does not include any adult entertainment uses.
      Right-of-way. An area or strip of land, either public or private, on which an irrevocable right-of-passage has been recorded for the use of vehicles or pedestrians or both.
      Rooming House. A residence with a maximum of five guest rooms that provides accommodations, with or without meals, for compensation to individuals for more than thirty (30) consecutive days.
      Sales Offices And Showrooms. Office or retail space designed to provide an area to demonstrate or show certain goods and materials that are large-scale or not necessarily a component of typical retail commercial uses including, but not limited to, kitchen showrooms, plumbing supply sales, appliance showrooms, office furniture supplies, etc.
      Satellite Dish Antenna. A parabolic dish antenna including its structural supports.
      School. A public school facility and building chartered by the Ohio Board of Regents or conforming to minimum standards prescribed by the State Board of Education and any private or parochial school certified by the State of Ohio which offers state-approved courses of instruction.
      Screening. A structure erected or vegetation planted for the purpose of concealing from view the area behind it.
      Self-Storage Facilities. A building or group of buildings in a controlled-access and fenced compound, which are rented to the public for the storage of personal property and which have independent access and locks under the control of the tenant.
      Service Commercial Uses. Establishments that primarily engage in rendering services to businesses including, but not limited to, printers, equipment rental, protective services, mailing, photo finishing, and other similar uses.
      Setback Line. The line created when applying the required setback distance to a lot. See also Yard, Required.
      Setback. The minimum distance a building or structure must be built from a property line or road right-of-way. Also referred to as the required setback.
      Side Yard. See Yard, Side.
      Sign. Any device visible from a public place whose essential purpose and design is to convey either commercial or noncommercial messages by means of graphic presentation of alphabetic or pictorial symbols or representations. See Section 1139.13 for definitions specific pertaining to signs.
      Similar Use. A use not specifically listed in any of the schedules of permitted uses of any district, but which may be found similar and added to a schedule for a particular district.
      Small Residential Facility. A licensed residential facility that complies with the regulations of either ORC 5119.341(A) for residential facilities for 1 to 5 persons with mental health issues or ORC 5123.19(M) residential facilities for 6 to 8 persons with developmental disabilities.
      Story. That portion of a building included between the surface of a floor and the surface of the floor next above it or if there be no floor above it, then the space between the floor and the ceiling next above.
      Structural Alterations. Any change which would tend to prolong the life of a supporting member of a structure such as bearing walls, columns, beams or girders.
      Structural Height. The vertical distance measured from the average elevation of the proposed finished grade at the front of the building to the highest point of the roof for flat roofs, to the deck line for mansard roofs, and the mean height between eaves and the ridge for gable, hip and gambrel roofs.
      Structure, Accessory. A structure (including buildings but not fences) that is accessory and incidental to the principal building.
      Structure. Anything constructed or erected, the use of which requires permanent location on the ground or attachment to something having a permanent location on the ground. All buildings are considered structures.
      Swimming Pool. A pool, pond, lake or open tank maintained by the owner or manager.
      Temporary Workforce Housing Facility. A facility designed and intended to be used for a temporary period to house a variety of field-related workers, including oil field, construction, etc. Such facilities are not intended to accommodate families with children. Temporary housing camps may include the use of skid units, travel-trailers, recreational vehicles, campers, mobile homes or a combination of these. Includes the terms “man camp”, “construction camp” or “crew housing facility”.
      Trailer. A vehicle without motive power that is designed or used for carrying property or persons wholly on its own structure and is drawn by a motor vehicle, and includes any such vehicle that is formed by or operated as a combination of a semi-trailer and a vehicle of a dolly type such as are commonly known as a trailer dolly, a vehicle used to transport agricultural produce, and a vehicle that is designed and used exclusively to transport a boat.
      Truck. Motor vehicles required by the Bureau of Motor Vehicles to be registered as trucks and are of a body size greater than one ton.
      Urgent Care Clinic. A facility which provides diagnostic, minor surgical, therapeutic or other medical care and treatment on an out-patient basis, and patients are not lodged overnight.
      Use, Principal. The main use to which the premises are devoted and the primary purpose for which the premises exist.
      Use. The specific purposes for which land or a building is designated arranged or intended, or for which it is or may be occupied or maintained.
      Vehicle Repair Garage (Major Repair). A facility that provides major engine overhauls and collision repair services, including body frame straightening and repair, replacement of damaged parts, and painting.
      Vehicle Service Use (Minor Repair). A building, structure, or land used for the general repair and routine maintenance of automobiles, motorcycles, trucks, trailers, or similar vehicles including, but not limited to, muffler, oil change and lubrication, tire service and sales, installation of accessory, or engine repair. All activities shall take place within an enclosed building.
      Vehicle. Everything on wheels or runners, including motorized bicycles.
      Waiting Space Or Lane. A lane or area that is specifically designated for cars to “stack” in while utilizing drive-up or drive-through services at uses that may include, but are not limited to, car washes, restaurants, and financial institutions.
      Warehouse. A building used primarily for the storage of goods and materials which are intended for future sale or use but specifically excluding commercial multi-unit self-storage facilities.
      Wholesale Business. A business establishment that sells commodities in large quantities or by the piece to retailers, jobbers, other wholesale establishments, or manufacturing establishments. These commodities are for further resale, for use in the fabrication of a product, or for use by a business service.
      Yard, Corner Side. On a corner lot, the yard between the principal building and the side lot line adjacent to the side street and extending from the front yard to the rear lot line.
      Yard, Front. The area across the full width of the lot between the front of the main building and the front line of the lot.
      Yard, Rear. A yard extending across the full width of the rear of a lot extending from the rear lot line and the rear of the principal building. On a corner lot, the rear yard shall be the area between the rear lot line and the principal building, extending from the side lot line abutting an interior lot to the side yard abutting a street.
      Yard, Required. The open space between a lot line and a setback line for a building, parking area or use that is the minimum area required to comply with the regulations of the district in which the lot is located, and within which no structure shall be located except as expressly permitted in this Planning and Zoning Code. See also Setback Line.
      Yard, Side. The area between the principal building and the side line of the lot extending from the front wall to the rear wall of the principal building.
      Yard. An open space on the same lot with a building, unoccupied and unobstructed by any portion of a structure from the ground upward, except as otherwise provided herein. In measuring a yard for the purpose of determining the width of a side yard, the depth of a front yard or the depth of a rear yard, the minimum horizontal distance between the lot line and the nearest portion of the main building shall be used.
      Zoning District Map. The zoning district map or maps of the Village together with all amendments subsequently adopted.
      Zoning District. The portion of the Village for which zoning regulations govern the use of buildings and premises and the height and size of buildings or structures located thereon.
