1309.11 RIGHT TO APPEAL.
   The owner, occupant, agent or operator of any structure or premises shall have the right to appeal from any written notice issued by the Village Council or its authorized agent, by making demand for a hearing on whether a public nuisance exists, within thirty (30) days after completion of service of notice. The hearing shall be held within ten (10) days following the receipt of written demand for hearing and at least two (2) days notice of the hearing, in writing, shall be given to the occupant, owner or operator. The hearing shall be conducted by Council. A majority of the members of Council must concur that a public nuisance, as defined in this chapter, exists before enforcement of the abatement is carried out. A copy of the decision of Council shall be promptly served upon the occupant, owner or operator as provided in the “Notice of Violation” section of this chapter.
