(a) Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
(1) “Animal” means any domestic animal, including, but not limited to, dogs and cats.
(2) “Owner” means a person who harbors, keeps, controls or possesses an animal.
(3) “Parade” means a pre-planned and organized procession of at least five units upon the street(s) of the Village of Woodsfield, for which normal traffic patterns have been altered or re-routed.
(4) “Private land” means any and all property owned by individuals, businesses, or any legal entity and located within the municipal corporation limit of the Village of Woodsfield.
(5) “Public land” means any and all property that does not constitute private property, including but not limited to property owned by the Village of Woodsfield, including sidewalks, rights of way and streets.
(6) “Waste” means fecal matter derived from animals.
(b) Prohibition of Deposit of Animal Waste Upon Land Other than That of the Owner. No owner of any animal shall permit such animal to deposit waste upon public or private land in the City, other than that of the owner.
(c) Requirement to Remove and Deposit of Animal Waste upon Land Other Than That of the Owner. Any owner observing or learning of his or her animal depositing waste upon public or private land, other than that of the owner, shall immediately remove such waste from such land and dispose of such waste in an enclosed container.
(d) Exception for Parades. The provisions of this section are not intended for and shall not be enforced during the performance of any parade through the Village of Woodsfield.
(e) Penalty. Whoever violates or fails to comply with any of the provisions of this section is guilty of a minor misdemeanor.
