351.13 PARKING DURING A SNOW EMERGENCY.
   (a)   A snow emergency shall be declared whenever there is a snowfall exceeding two inches in depth in any consecutive twelve-hour period.
   (b)   For the purposes of this chapter alone, a motor vehicle is defined as an automobile, a truck, a motorcycle or any vehicle propelled by a motor of any kind. This includes motorized recreational vehicles, motor homes and off-the-road vehicles which may be parked on Village streets.
   (c)   No person being the owner or operator of a motor vehicle shall cause or permit the same to be parked or to remain stationary, unless in the event of an emergency, on any street in the Municipality during the period from midnight until 9:00 a.m. on any day during which the snowfall exceeds two inches and constitutes a snow emergency as defined in subsection (a) hereof.
   (d)   Vehicles may be returned to the street after the snow removal has been completed by the Village. However, there shall be no defense under this chapter that the party so parking the vehicle assumed snow removal had been completed.
   (e)   Any employee, officer, member of Council or duly authorized agent of the Municipality or its employees, officer or member, is permitted to move any vehicle which is the subject of a violation of this chapter for the purposes of aiding in snow removal from the streets of the Municipality and, if necessary, to have the offending vehicle towed and stored and the cost of such towing and storing assessed to the owner and/or operator of the vehicle.

   (f)   Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
