8-2-12: ENFORCEMENT AND PENALTIES:
   A.   Enforcement Officer: The village building official is hereby authorized and directed to receive complaints and conduct such investigations of violations of this chapter as he deems necessary pursuant to the authority vested in him by his office.
   B.   Remedies: Whenever it is determined by the building official that there has been a violation of this chapter, said building official shall be authorized to:
      1.   Conciliate the matter by conference or otherwise and secure a written conciliation agreement; or
      2.   Obtain a written assurance of discontinuance of the violation which shall be signed by the developer and the building official.
   C.   Failure To Remedy; Enjoining Violations: In the event that the building official determines that a violation of this chapter exists and the same is not remedied under the provisions of subsection B of this section, then the village administrator, with the concurrence of the mayor and board of trustees, shall direct the village legal counsel to apply to any court of competent jurisdiction to enjoin any violation of this chapter, or to take such other and further action as they, in their discretion, may deem necessary.
   D.   Penalties:
      1.   Any person who violates, disobeys, omits, neglects, refuses to comply with or who resists enforcement of any of the provisions of this chapter, other than wilfully making an untrue or misleading statement of material fact or wilfully omitting a material fact in the property report, shall, upon conviction, be fined one hundred dollars ($100.00) per day for each unit with respect to which a violation has occurred. Each day during which any unit has been advertised or offered for sale, and such advertisement or offer has not been withdrawn, shall constitute a separate offense.
      2.   Any person who wilfully makes an untrue or misleading statement of material fact or who wilfully omits a material fact in the property report shall be subject to the penalty provisions of title 1, chapter 4 of this code. (Ord. 2013-29, 6-13-2013)
