8-2-11: EXEMPTIONS FROM VARIOUS PROVISIONS:
   A.   Exclusion Of Small Developments: The provisions of this chapter shall not apply to conversions or new construction of condominium projects containing four (4) dwelling units or less; provided, however, that all condominium conversions regardless of the number of units contained therein shall be subject to the village inspection and the report provisions of this chapter. Moreover, nothing contained in this section shall exclude or exempt any condominium project from conforming to the requirements of the act.
   B.   Resale Of Previously Inspected Condominium Units: This chapter shall not apply to the resale of any condominium unit:
      1.   For which a certificate of inspection has been previously issued pursuant to the terms of this chapter; or
      2.   Which was originally designed and sold under the act prior to the effective date of this chapter if a certificate of occupancy has been issued with respect thereto.
   C.   Waiver Of Certain Village Codes: The requirements for compliance with current village codes with respect to condominium conversions may be waived under the following circumstances:
      1.   With respect to the number of off street parking spaces:
         a.   If the number of off street parking spaces currently available was in compliance with the codes in effect when the condominium unit was constructed; or
         b.   If compliance with current codes would lessen the number of off street parking spaces available to unit owners, then such current code requirements may be waived.
      2.   With respect to other provisions of the codes, if the building containing the condominium unit and the common elements were in compliance with the codes in effect when the condominium unit was constructed and if current code compliance would require structural changes, the current code provisions may be waived.
      3.   With respect to the total number of and location of condominium units, if the said number and location were in compliance with the codes in effect when the building was constructed, those requirements under current existing codes may be waived. (Ord. 2013-29, 6-13-2013)
