8-2-5: WARRANTIES:
Any agreement for sale of a condominium unit under the provisions of this chapter shall contain a warranty that the condominium unit and the common elements are in good condition, free from any latent or patent defects and that the developer shall repair or replace any defect in said condominium unit or the common elements at the developer's sole cost promptly upon being notified in writing of such defect by the purchaser of such condominium unit or the association, as the case may be; provided, however, that such notice of defect must be delivered to the developer within one year from the date of conveyance of title thereto to the purchaser.
