1-3-2: DEFINITIONS, GENERAL:
Whenever the following words or terms are used in this code, they shall have such meanings herein ascribed to them, unless the context makes such meanings repugnant thereto:
AGENT: A person acting on behalf of another with authority conferred either express or implied to do so.
BOARD, BOARD OF TRUSTEES, VILLAGE BOARD: Whenever the term "board", "board of trustees" or "village board" is used, it shall be construed to mean the board of trustees of the village of Woodridge.
CODE: The municipal code of Woodridge, Illinois, and amendments thereto.
COMPUTATION OF TIME: Whenever a notice is required to be given or an act to be done a certain length of time before any proceeding shall be had, the day on which such notice is given, or such act is done, shall be counted in computing the time, but the day on which such proceeding is to be held shall not be counted. "Time" shall mean Central Standard Time, except when the state of Illinois is on daylight saving time and then it shall mean Central Daylight Saving Time.
CORPORATE OR VILLAGE LIMITS: The legal boundaries of the village of Woodridge.
COUNTY OR THIS COUNTY: DuPage and/or Will Counties, Illinois.
DELEGATION OF AUTHORITY: Whenever a provision appears requiring the manager of a department or some other village officer to do some act or perform some duty, it is to be construed to authorize the manager of the department or other officer to designate, delegate and authorize subordinates to perform the required act or perform the duty unless the terms of the provision or section specify otherwise.
EMPLOYEES: Whenever reference is made in this code to a village employee by title only, this shall be construed as though followed by the words, "of the village of Woodridge".
FEE: A sum of money charged by the village for the carrying on of a business, profession or occupation.
FISCAL YEAR: The fiscal year of the village shall extend from January 1 through December 31; provided, however, that the first fiscal year after the effective date hereof shall begin on May 1, 2014, and shall end on December 31, 2014.
GENDER: A word importing the masculine gender only shall extend and be applied to females and to firms, partnerships and corporations as well as to males.
JOINT AUTHORITY: All words giving a joint authority to three (3) or more persons or officers shall be construed as giving such authority to a majority of such persons or officers.
LICENSE: The permission granted for the carrying on of a business, profession or occupation.
MAYOR: See definition of Village President.
MISDEMEANOR: Any offense for which a sentence to a term of imprisonment in other than a penitentiary for less than one year may be imposed.
MONTH: A calendar month.
NONTECHNICAL AND TECHNICAL WORDS: Words and phrases shall be construed according to the common and approved usage of the language, but technical words and phrases and such others as may have acquired a peculiar and appropriate meaning in law shall be construed and understood according to such meaning.
NUISANCE: Anything offensive to the sensibilities of reasonable persons, or any act or activity creating a hazard which threatens the health and welfare of inhabitants of the village; or any activity which by its perpetuation can reasonably be said to have a detrimental effect on the property of a person or persons within the community.
NUMBER: A word importing the singular number only may extend and be applied to several persons and things as well as to one person and thing.
OATH: Includes an affirmation in all cases in which, by law, an affirmation may be substituted for an oath, and in such cases the words "swear" and "sworn" shall be equivalent to the words "affirm" and "affirmed".
OCCUPANT: As applied to a building or land, shall include any person who occupies the whole or any part of such building or land whether alone or with others.
OFFENSE: Any act forbidden by any provision of this code or the omission of any act required by the provisions of this code.
OFFICER: Any person defined to be an officer of the village by the statutes of the state of Illinois or this code, as the same may be amended from time to time.
Whenever any officer is referred to by title, such as "village clerk", "chief of police", "mayor", etc., such reference shall be construed as if followed by the words "of the village of Woodridge".
OFFICIAL: Any officer of the village or any employee of the village who is charged with the interpretation and enforcement of any provision of this code.
OPERATOR: The person who is in charge of any operation, business or profession.
OWNER: The word "owner" applied to a building or land shall include any part owner, joint owner, tenant in common, tenant in partnership, joint tenant or tenant by the entirety of the whole or of a part of such building or land.
PERSON: Any individual, firm, association, partnership, corporation, trust or any other legal entity.
PERSONAL PROPERTY: Includes every species of property except "real property" as defined herein.
PRECEDING, FOLLOWING: Next before and next after, respectively.
PROPERTY: Includes real and personal property.
REAL PROPERTY: Includes lands, tenements and hereditaments.
RETAILER: Unless otherwise specifically defined, shall be understood to relate to the sale of goods, merchandise, articles or things direct to the consumer.
SHALL: Is mandatory.
SIDEWALK: Any portion of a street between the curb line and the adjacent property line intended for the use of pedestrians, excluding parkways.
SIGNATURE OR SUBSCRIPTION: Includes a mark when the person cannot write.
STATE: The words "the state" or "this state" shall be construed to mean the state of Illinois.
STREET: Embraces streets, avenues, boulevards, roads, alleys, lanes, bike paths, sidewalks, viaducts and all other public ways in the village and shall include all areas thereof embraced between the property lines and dedicated to the public use.
TENANT OR OCCUPANT: When applied to a building or land shall include any person holding a written or oral lease or who occupies the whole or a part of such building or land, either alone or with others.
TENSE: Words used in the past or present tense include the future as well as the past and present.
VILLAGE: The village of Woodridge.
VILLAGE PRESIDENT: The president of the village shall hereafter be referred to as "mayor" of the village.
WHOLESALE, WHOLESALER, ETC.: In all cases where the term "wholesale", "wholesaler" or "wholesale dealer" is used in this code, unless otherwise specifically defined, it shall be understood and held to relate to the sale of goods, merchandise, articles or things in quantity to persons who purchase for purposes of resale, as distinguished from a retail dealer who sells in smaller quantities direct to the consumer.
WRITTEN OR IN WRITING: Includes any representation of words, letters or figures, whether by printing or otherwise.
