For the purpose of this chapter, the following words shall be defined as follows:
HEARING OFFICER: An attorney licensed to practice law in the state of Illinois for a minimum of three (3) years, designated by the village administrator to serve as the hearing officer in regard to hearings held pursuant to this chapter.
MOTOR VEHICLE: Any device in, upon or by which any person or property is or may be transported or drawn upon a street, highway or any public way, except devices moved by human power, devices used exclusively upon stationary rails or tracks, and snowmobiles.
UNLAWFUL VEHICLE:
A. A vehicle that is the subject of a search and seizure by the police department.
B. A vehicle towed incident to arrest.
C. A vehicle that is used in connection with any of the following:
1. Commission or attempted commission of an offense for which a motor vehicle is subject to seizure and forfeiture pursuant to 720 Illinois Compiled Statutes 5/36-1 or 36.5-5;
2. Commission or attempted commission of an offense for which a motor vehicle is subject to seizure and forfeiture pursuant to the narcotics profit forfeiture act 1 ;
3. Driving under the influence of alcohol, another drug or drugs, an intoxicating compound or compounds, or any combination thereof, in violation of 625 Illinois Compiled Statutes 5/11-501;
4. The commission of, or attempted commission of an offense in violation of the cannabis control act 2 ;
5. The commission of, or attempted commission of, an offense in violation of the Illinois controlled substances act 3 ;
6. Driving while a driver's license, permit, or privilege to operate a motor vehicle is suspended or revoked pursuant to 625 Illinois Compiled Statutes 5/6-303, unless the suspension is for an unpaid citation (parking or moving) or due to failure to comply with emission testing;
7. Soliciting, possessing, or attempting to solicit or possess cannabis or a controlled substance, as defined by the cannabis control act or the Illinois controlled substances act;
8. Operation or use of a motor vehicle with an expired driver's license, in violation of 625 Illinois Compiled Statutes 5/6-101, if the period of expiration is greater than one year;
9. Operation or use of a motor vehicle without ever having been issued a driver's license or permit, in violation of 625 Illinois Compiled Statutes 5/6-101, or operation of a motor vehicle without ever having been issued a driver's license or permit due to a person's age;
10. Operation or use of a motor vehicle by a person against whom a warrant has been issued by a circuit clerk in Illinois for failing to answer charges that the driver violated 625 Illinois Compiled Statutes 5/6-101, 6-303 or 11-501;
11. Operation or use of a motor vehicle in violation of 625 Illinois Compiled Statutes 5/11-503 while the vehicle is part of a funeral procession or in a manner that interferes with a funeral procession;
12. The commission of, or attempted commission of, any misdemeanor or felony offense in violation of the criminal code of 2012 4 , or any corresponding violation of this code; or
13. A vehicle where the registered owner is a Chronic Parking Violator, as defined in Section 6-11-6 herein.
14. Any other violation described in 625 Illinois Compiled Statutes 5/11-208.7(b). (Ord. 2014-45, 7-24-2014, eff. 9-1-2014; amd. Ord. 2021-2, 1-21-2021)
