6-2-8: ACCIDENTS:
   A.   Duty Of Driver Involved In Accident:
      1.   Accidents Involving Death Or Personal Injuries: The driver of any vehicle involved in an accident resulting in injury to or death of any person shall immediately stop such vehicle at the scene of such accident, or as close thereto as possible, and shall then forthwith return to, and in every event shall remain at the scene of an accident until he has fulfilled the requirements of subsection A3 of this section. Every such stop shall be made without obstructing traffic more than is necessary. (1976 Code §19-183)
      2.   Accidents Involving Damage To Vehicle: The driver of any vehicle involved in an accident resulting only in damage to a vehicle which is driven or attended by any person shall immediately stop such vehicle at the scene of such accident, or as close thereto as possible, but shall forthwith return to and in every event shall remain at the scene of such accident until he has fulfilled the requirements of subsection A3 hereof. Every such stop shall be made without obstructing traffic more than is necessary. (1976 Code §19-184)
      3.   Give Information and Render Aid: The driver of any vehicle involved in an accident resulting in injury to or death of any person or damage to any vehicle which is driven or attended by any person shall give his name, address and the registration number of the vehicle he is driving and shall upon request and if available exhibit his driver's license to the person struck or the driver or occupant of or person attending any vehicle collided with and shall render to any person injured in such accident reasonable assistance, including the carrying or the making of arrangements for the carrying of such person to a physician, surgeon or hospital for medical or surgical treatment if it is apparent that such treatment is necessary or if such carrying is requested by the injured person.
If none of the persons entitled to information pursuant to this subsection A3 is in condition to receive and understand such information and no police officer is present, such driver after rendering reasonable assistance shall forthwith report such accident at the nearest office of a duly authorized police authority, disclosing the information required by this subsection A3.       4.   Damaging Unattended Vehicle or Other Property: The driver of any vehicle which collides with or is involved in an accident with any vehicle which is unattended, or other property, resulting in any damage to such other vehicle or property shall immediately stop and shall then and there either locate and notify the operator or owner of such vehicle or other property of his name, address and the registration number of the vehicle he is driving or shall attach securely in a conspicuous place on or in the vehicle or other property struck a written notice giving his name, address and the registration number of the vehicle he is driving and shall without unnecessary delay notify the nearest office of a duly authorized police authority and shall make a report of such accident when and as required in subsection B of this Section. Every such stop shall be made without obstructing traffic more than is necessary. (1976 Code §19-186)
   B.   Accident Reports:
      1.   Reports Required:
         a.   The driver of a vehicle which is in any manner involved in an accident within this Village resulting in injury to or death of any person or in which damage to the property of any one person, including himself, in excess of two hundred fifty dollars ($250.00) is sustained shall, as soon as possible but not later than ten (10) days after such accident, forward a written report of such accident to the Police Department.
The Police Department may require any driver, occupant or owner of a vehicle involved in an accident of which report must be made as provided in this subsection B1a to file supplemental reports whenever the original report is insufficient in the opinion of the Police Department and may require witnesses of the accident to submit reports to the Police Department.
Should the Police Department learn through other reports of accidents required by law of the occurrence of an accident reportable under this Section and the driver, owner or witness has not reported as provided under subsection B1a within the time specified, such person is not relieved of the responsibility and the Chief of Police or his designee shall notify such person by first class mail to his last known address of his legal obligation. However, such notification is not a condition precedent to impose the penalty for failure to report. (1976 Code §19-188)
         b.   Whenever the driver of a vehicle is physically incapable of making a required accident report and if there was another occupant in the vehicle at the time of the accident capable of making a report, such occupant shall make or cause to be made such report. If said driver fails for any reason to make such report, the owner of the vehicle involved in such accident shall, as soon as he learns of the accident, make said report to the Police Department.       2.   Accident Reports Confidential: All required accident reports and supplemental reports shall be without prejudice to the individual so reporting and shall be for the confidential use of the Police Department; except, that the Police Department may disclose the identity of a person involved in an accident when such identity is not otherwise known or when such person denies his presence at such accident. No such report shall be used as evidence in any trial, civil or criminal, arising out of an accident; except, that the Police Department shall furnish upon demand of any person who has or claims to have made such a report or upon demand of any court a certificate showing that a specified accident report has or has not been made to the Police Department solely to prove a compliance or a failure to comply with the requirement that such a report be made to the Police Department.       3.   Copies of Reports for State: The Police Department may furnish to the Secretary of State copies of required accident reports or information taken from such reports. All such copies of reports or information taken from them shall be for the confidential use of the secretary of state. (1976 Code §19-191)
   C.   Record Of Accidents: The police department shall keep a record of all accidents, the names of parties to and the witnesses to such accidents and their statements in reference thereto. (1976 Code §19-187)
