3-3-21: CERTAIN SALES PROHIBITED:
   A.   It shall be unlawful for any licensee selling alcoholic beverages to be served and consumed on the licensed premises to engage in any of the following enumerated practices:
      1.   Deliver more than two (2) drinks to one (1) person at one time.
      2.   Sell, offer or deliver to any person an unlimited number of drinks during any set period of time for a fixed price, except at private functions not open to the public.
      3.   Increase the volume of alcoholic beverages contained in a drink without increasing proportionately the price charged for such drink.
      4.   Encourage or permit on the licensed premises any game or contest which involves drinking or the awarding of drinks as prizes.
      5.   Advertise or promote in any way, whether within or without the licensed premises, any of the above practices.
   B.   The prohibited practices contained in the above provisions shall not prohibit the licensee from:
      1.   Offering free food or entertainment at any time;
      2.   Including drinks as part of a meal package;
      3.   Free wine tastings;
      4.   Offering room services to registered guests in hotels licensed for such service;
      5.   Selling or offering for sale drinks at a discount to the public provided that:
         a.   Discounted drinks can be offered for up to four (4) hours per day.
         b.   Discounted drinks cannot be offered for more than fifteen (15) hours per week.
         c.   Drinks cannot be discounted between ten o'clock (10:00) P.M. and the closing hour of the licensed premises.
         d.   The price of the drink cannot change during the discounted drink period.
         e.   Notice of the discount must be posted on the licensed premises' website seven (7) days prior to the offering of discounted drinks;
      6.   Selling or offering for sale drinks at a discount during private functions not open to the public;
      7.   Selling or offering for sale a party package only if the retail licensee:
         a.   Offers food in the dedicated event space.
         b.   Limits the party package to no more than three (3) hours.
         c.   Distributes wristbands, lanyards, shirts, or any other such wearable items to identify party package attendees so the attendees may be granted access to the dedicated event space.
         d.   Excludes individuals not participating in the party package from the dedicated event space;
      8.   Including drinks of alcoholic liquor as part of a hotel package;
      9.   Negotiating drinks of alcoholic liquor as part of a hotel package;
      10.   Selling pitchers (or the equivalent, including, but not limited to, buckets of bottled beer), carafes, or bottles of alcoholic liquor which are customarily sold in such manner, or sell bottles of spirits; or
      11.   Advertising events permitted under this section.
   C.   No licensee or officer, associated member, representative, agent or employee of such licensee shall sell, give or deliver alcoholic liquor to any person under the age of twenty one (21) years 1 , or to any intoxicated person, or to any person known by him to be a habitual drunkard, insane, mentally ill, mentally deficient or in need of mental treatment.
