PURPOSE AND ACTION REQUESTED:
Staff is requesting Village Board consideration of a proposed Ordinance to amend Title 7, Chapter 5, Section 7-5D-2, Water Service Rates and Charges to reflect the new water rate effective May 1, 2022.
 
BACKGROUND:
On November 18, 2021, the Village Board, through Ordinance 2021-40, authorized a pass through of a rate increase in the event the DuPage Water Commission (DWC) increased their water rates on or after January 1, 2022.
 
Ordinance 2021-40 added the following language to Village Code to automatically pass-through any increase in rates from the DuPage Water Commission:
 
RECOMMENDATION:
Staff is recommending Village Board approval of a proposed Ordinance to amend Title 7, Chapter 5, Section 7-5D-2, Water Service Rates and Charges to reflect the new water rate effective May 1, 2022.
 
 
ACTION PROPOSED:
Approval of the Ordinance
 
An Ordinance Amending the Village Code of the Village of Woodridge - Title 7, Chapter 5, Article D - Water and Sewer Regulations; Fees, Rates and Charges - Sections, 7-5D-2B.1, and 7-5D-2B.2
 
 
WHEREAS, the Village of Woodridge (the “Village”) is a home rule municipality in accordance with the Constitution of the State of Illinois of 1970;
WHEREAS, the Village provides water service to customers both inside and outside the corporate limits;
WHEREAS, the rate for such water service is established and set forth in Village Code of the Village of Woodridge (the “Code”);
WHEREAS, the Village purchases Lake Michigan water from the City of Chicago, through the DuPage Water Commission;
WHEREAS, the City of Chicago increases the rate to purchase water annually;
WHEREAS, the DuPage Water Commission has passed on this rate increase to the Village; and
WHEREAS, the Corporate Authorities, in exercising its fiduciary duties and responsibilities must now, in consideration of the above in conjunction with other increases in the cost of providing water service to its customers, have determined it to be in the best interests of the Village and its residents to amend the Code to adjust the water rates charged accordingly.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF WOODRIDGE, DU PAGE, WILL AND COOK
COUNTIES, ILLINOIS, a home rule municipality in the exercise of its home rule powers, as follows:
SECTION ONE : That the recitals set forth hereinabove are incorporated herein by reference as substantive provisions of this Ordinance.
SECTION TWO: That Title 7, Section 7-5D-2B.1 of the Code is hereby amended as follows:
By deleting all reference to the language “eight dollars twenty-eight cents ($8.28)” contained therein in its entirety and in lieu thereof, the following language shall be substituted:
…“eight dollars forty-nine cents ($8.49)”…
By deleting all reference to the language “In the event the DuPage Water Commission should increase its water rate on or after January 1, 2022, ending on December 31, 2022, then the water rate contemplated under 7-5D-2B
 
of the Village Code of the Village of Woodridge shall be automatically adjusted to reflect such increases as of the first day of the following billing cycle.” contained therein in its entirety and in lieu thereof, the following language shall be substituted:
…“Effective for all water usage billed on or after May 1, 2022”…
SECTION THREE: That the rate changes provided for herein shall take effect for all water usage billed on and after May 1, 2022.
SECTION FOUR : If any section, paragraph, clause, sentence or provision of this Ordinance shall be found and determined to be invalid by a court of competent jurisdiction, all valid parts that are severable from the invalid parts shall remain in full force and effect.
SECTION FIVE: That all ordinances and resolutions or parts thereof in conflict with the provisions of this Ordinance are, to the extent of such conflict, expressly repealed.
SECTION SIX: That this Ordinance shall be in full force and effect ten (10) days from and after its passage, approval, and publication in pamphlet form as provided by law.
