Sec. 12.407. International Property Maintenance Code Amendments.
   A.   General Provisions:
      1.   Graffiti:
         a.   It shall be the duty of the owner of the structure or wall upon which any graffiti has been placed to remove, eradicate or eliminate such graffiti within fifteen (15) days from its placement upon such structure or wall. (For purposes of this subsection, the term "graffiti" shall include but shall not be limited to the following illustrative items: any drawing, inscription, word, phrase, diagram, symbol, sketch, or letters containing references to sexual activity, diagrams relating to the sexual activity or sexual organs, references to criminal activities, or groups which promote or are involved in criminal activity, swearing or fighting words, defamatory materials about any person or references to relationships.)
            (1)   In the event the owner of the structure or wall upon which any graffiti has been placed has failed to eliminate such graffiti, the owner shall be notified via certified mail or personal notice by the City of such failure and shall be given an additional fifteen (15) days to remove such graffiti.
            (2)   In the event the owner of such structure or wall upon which any graffiti has been placed can show to the City there is a reasonable likelihood that the person responsible for placement of the graffiti will be required to make restitution or restore such structure or wall to its previous condition, the owner may be given additional time to meet the removal requirements without charges being filed. In no event shall the owner be granted more than ninety (90) days' time to cause the removal of the graffiti. All appeals for additional time to comply with the provisions of this section shall be made to the City of Wood Dale Police Department.
         b.   Notwithstanding the language contained in subsection A1a of this section, it shall be unlawful and a misdemeanor for any owner of such structure or wall to permit or allow graffiti to remain thereon for a period in excess of thirty (30) days.
      2.   Door/Window Coverings: Any structure within the City of Wood Dale that has its exterior doors and windows covered by sheathing, planking, or any other type of solid materials either by direction of the building official, or due to any other reason, including, but not limited to, property damage, repair, abandonment of use or occupancy, and/or demolition, shall comply with the following requirements: a) the material used shall be weathertight, b) the material used to cover said exterior doors or windows shall be painted with an opaque finish that matches as closely as possible the predominant color of the structure, c) the finish shall be maintained in full compliance with the Property Maintenance Code so as to prevent the material/structure from causing a blight type condition to be established.
      3.   Open Space: All open space on a lot (areas not improved with structures) shall be planted and maintained with landscaping consisting of live plantings, such as turf, trees, shrubs, and planting beds.
   B.   Amendments: The deletions from and modifications and amendments to the 2012 International Property Maintenance Code are as follows:
Chapter 1 Scope and Administration
Section 101.1 Title delete in its entirety and replace with:
101.1 Title. These regulations shall be known as the Property Maintenance Code of the City of Wood Dale, and shall be cited as such and will hereinafter be referred to as "this code".
Section 102.3 Application of other codes delete the following words "International Existing Building Code" and "International Plumbing Code".
Section 102.3 Application of other codes delete the following words "International Zoning Code" and replace with City of Wood Dale Unified Development Ordinance.
Section 103 Department of Property Maintenance Inspections delete section in its entirety.
Section 104 Duties and Powers of the Code Official delete section in its entirety.
Section 109 Emergency Measures delete section in its entirety.
Section 111 Means of Appeals delete section in its entirety.
Section 112 Stop Work Order delete section in its entirety.
Chapter 3 General Requirements
Section 302.4 Weeds delete the first sentence and replace with:
All premises and exterior property shall be maintained free from nuisance greenery and in accordance with Chapter 6, Article II, Sec. 6.206 of the Municipal Code.
Section 302.4 Weeds delete the following words "in accordance with Section 106.3 and"
Section 304.1.1 Unsafe conditions delete the following words "or the International Existing Building Code"
Section 304.3 Premises identification delete section and replace with:
Section 304.3 Premises identification. Buildings shall have approved address numbers, building numbers or approved building identification mounted on the structure and placed in a position that is plainly legible and visible from the street or road fronting the property. These numbers shall contrast with their background. Address numbers shall be Arabic numbers and a minimum of 6 inches high with a minimum stroke width of 1/2 inch. Where access is by means of private road or the building address cannot be viewed from the public right of way, an additional address will be posted on a monument, pole or other sign or means to identify the structure.
Section 304.14 Insect screens add the following dates "from April 1st to November 1st"
Section 305.1.1. Unsafe conditions delete the following words "or the International Existing Building Code"
Section 306.1.1. Unsafe conditions delete the following words "or the International Existing Building Code"
Chapter 6 Mechanical and Electrical Requirements
Section 602.3 Heat supply add the following dates "from October 1st to May 15th".
Section 602.4 Occupiable work spaces add the following dates "from October 1st to May 15th".
