(a) Responsibility. Maintenance of stormwater facilities shall be the responsibility of the person or persons holding title to the property. These persons are responsible for the continual operation, maintenance, and repair of stormwater facilities and BMPs in accordance with the provisions of this chapter. For privately maintained stormwater facilities, the maintenance requirements specified in this chapter shall be enforced by the Village against the owner(s) of the property served by the stormwater facilities.
(b) Maintenance Plan. A maintenance plan shall include specific maintenance activities for each stormwater facility and any other elements of the approved stormwater management plan. The maintenance plan shall be submitted simultaneously for municipal review with all other required elements of the stormwater management plan.
(c) Record Keeping. Parties responsible for the operation and maintenance of stormwater facilities shall make records of the installation and of all maintenance and repairs, and shall retain the records for at least five years. These records shall be made available to the Village during inspection of the facility and at other reasonable times upon request.
