606.05  REGULATION OF EXOTIC ANIMALS.
   (a)   Recognizing that, because of availability of training, breeding and animal husbandry, certain species of animals classified as exotic animals may become viewed by society as domesticated animals or household pets, such animals may qualify to be housed, caged or otherwise kept within the Village. Any evaluation or finding made in this regard will be made on a case by case basis. Previous approvals or denials will not impact the evaluation and decision of new reviews, regardless of animal type or species.
   (b)   In the event the Village Administrator verifies that an animal is exotic and not ordinarily kept as a household pet or farm animal, but is not dangerous in nature, the Village Administrator may then recommend to Village Council that a person be allowed to own or possess that exotic animal within the Village. The Village Administrator's recommendation will be based upon findings related to:
      (1)   The size, nature and character of the exotic animal;
      (2)   The breed of the exotic animal and its birth origin;
      (3)   The temperament of the exotic animal and any propensity it may have for becoming dangerous;
      (4)   The proximity of the exotic animal to adjoining properties;
      (5)   The nature of the surrounding neighborhood (i.e., how the land is used, the intensity of that use, etc.);
      (6)   Potential traffic congestion caused by the exotic animal;
      (7)   The effect or potential effect on the health, safety and welfare of the surrounding neighborhood (i.e., noise, odors, danger, etc.);
      (8)   Potential to create or introduce invasive species into the surrounding area.
      (9)   The nature and character of the land, building or structures to be utilized for the keeping, housing or caging of the exotic animal;
      (10)   The plan of care intended for the exotic animal, and any control measures which will be used in the keeping, housing or caging of that animal.
      (11)   Any other applicable and relevant standards which are determined by the Village Administrator to be reasonably related to the public health, safety and welfare.
   (c)   The Village Administrator shall consult with the Wolverine Lake police department, and any other public safety officials deemed necessary, and secure a written report of review to submit to Village Council in connection with the Administrator's recommendation.
   (d)   In connection with the Village Administrator's submission of his or her recommendation to Village Council, a notice of hearing shall be given not less than 15 days before the Council meeting, delivered by mail or other public or private delivery service, to the owner(s) of property assessed within 500 feet of the property that is subject of the exotic animal request.
   (e)   Village Council may approve, deny or amend the recommendation of the Village Administrator as to whether an exotic animal may be kept, housed or caged within the Village. Any person requesting such review from the Village shall be required to pay a non-refundable application fee to the Village prior o the initial review by the Village Administrator, which shall be set by resolution of Village Council, as may be amended from time to time.
