1052.99 PENALTY.
   (a)   Each public utility company, person, corporation or other entity who shall undertake the installation or replacement of utility wires, cables, pipes, conduits or any other equipment in violation of this chapter shall be guilty of a misdemeanor and shall be fined an amount not to exceed five hundred dollars ($500.00) per violation; or may be imprisoned in the County Jail for not more than ninety days, regardless of the number of violations; or may be both fined and imprisoned. In addition, the Village shall be entitled to seek such equitable relief as may be available by law.
   (b)   Each day that utility wires, cables, pipes, conduits or any other equipment shall be constructed or maintained, in violation of this chapter, shall constitute a separate violation.
