As used in this chapter, unless the context clearly indicates otherwise, certain words and phrases shall mean the following:
(a) "Commercial applicator" means any individual or entity who applies lawn fertilizer on turf in the Village in exchange for money, goods, services, or other valuable consideration.
(b) "Department" is the Village of Wolverine Lake Building Department.
(c) "Eutrophication" is the process by which lakes and streams are enriched by nutrients (usually phosphorus and nitrogen) which leads to excessive plant growth – algae in open water, periphyton (attached algae) along the shoreline, and macrophytes (the higher plants called weeds) in the nearshore zone.
(d) "Fertilizer" is a substance containing one or more recognized plant nutrients, which substance is used for its plant nutrient content and which is designed for use, or claimed to have value, in promoting plant growth.
(e) "Institutional applicator," except as limited by the last sentence of this definition, means any individual or entity that applies fertilizers for the purpose of maintaining turf areas of more than one acre. Institutional applicators shall include, but shall not be limited to, owners, operators, and caretakers of public lands, schools, parks, religious institutions, utilities, industrial or business sites and any residential properties maintained in condominium and/or common ownership. Owners of individual parcels in single-family residential districts shall not be considered as institutional applicators.
(f) "Lake frontage property" means property with frontage on a lake or a river, stream or canal that leads to a lake.
(g) "Lawn fertilizers" means any fertilizer, manufactured fertilizer, or mixed fertilizer that is produced, marketed or labeled for use on turf with instructions as to application of the fertilizer to turf or any substance known to contain recognized nutrients for plant growth, that may be applied to turf. Lawn fertilizer does not include marl, lime, limestone, or natural compost.
(h) "Manufactured fertilizer" is a commercially manufactured substance which enriches the soil containing elements essential for turf growth, being primarily nitrogen, phosphorous, and potassium.
(i) "Mixed fertilizer" means a fertilizer containing any combination or mixture of fertilizer materials designed for use or claimed to have value in promoting plant growth, including mixtures of fertilizer and pesticide.
(j) "Turf" is a covering of grass vegetation which has both aesthetic and functional benefits maintained at a given level of management: managed grasses including, but not limited to, residential and commercial property, property owned by federal, state, or local units of government, including parks and recreation areas. Turf does not mean pasture, hayland, hay, turf grown on turf farms, or any other form of agricultural production.
(k) Note: In keeping with the general practice of manufacturers of fertilizer, the elements of Nitrogen (N), Phosphorous (P), and Potassium (K) may be expressed by their respective chemical symbol.
