850.09 ISSUANCE/DENIAL OF IDENTIFICATION CARD.
   (a)   An Identification Card shall be issued within forty-eight (48) hours of completion of an application, unless it is determined within that time that:
      (1)   Any statement upon the application is false, unless the applicant can demonstrate that the falsehood was the result of excusable neglect.
      (2)   Any applicant has been convicted of a violation of this Chapter or whose Identification Card has previously been revoked by the Village.
      (3)   Any applicant has been convicted of a felony or a misdemeanor involving moral turpitude within the past seven (7) years.
   (b)   If a Canvasser requests an Identification Card, an investigation will proceed as described in this Chapter. If the Village refuses to issue an Identification Card to a Canvasser, that Canvasser shall not be prevented from canvassing within the Village.
   (c)   If the Chief of Police, or his or her designee, denies an Identification Card, such denial shall be immediately conveyed to the applicant. Within forty-eight (48) hours of the denial, the Village shall prepare a written report which shall be issued, by certified mail, to the applicant, and the applicant shall be invited to respond to the report and present evidence in support of his or her response.
   (d)   Denials may be appealed to the Village Administrator, or his or her designee. The Village Administrator, or his or her designee, shall make a written determination after presentation by the applicant as to whether or not the grounds for denial should be upheld. If the Village Administrator determines that such grounds are supported by a preponderance of the evidence, the applicant may appeal the Village Administrator's decision to the Village Council. Review by the Village Council shall be under the same standards of review as the determination by the Village Administrator and shall be in accordance with rules of procedure established by the Village Council. The Village Council's decision may be reviewed by a court of competent jurisdiction.
