(A) Petition for wavier for prefab or mobile home.
(1) To receive a waiver for a prefab or mobile home, the owner of the prefab or mobile home shall obtain and complete an application from the town.
(2) The owner of the prefab or mobile home shall circulate a petition among all owners of land, as shown by the current year’s tax rolls in the office of the County Treasurer, within 300 feet of the tract that is the proposed site of the prefab or mobile home. A petition of waiver shall be an affidavit from the applicant listing the names and mailing address, as reflected by the current year’s tax rolls in the office of the County Treasurer, of all owners within 300 feet of the tract that is the proposed site of the prefab or mobile home. At least 70% of the property owners within 300 feet of the tract that is the proposed site of the prefab or mobile home must sign the petition for waiver.
(3) The lot shall be a minimum of 6,000 square feet. The lot shall meet and is subject to all “lot split” approval requirements of the town. Only on trailer per lot.
(4) All prefab or mobile homes receiving a waiver under this section must have a permanent foundation and meet current and future town standards.
(5) All axles, wheels and tongues must be covered by the underpinning or removed.
(6) To obtain a waiver, all prefab or mobile homes must be less than 15 years old and have maintained 80% of the original appearance have a minimum of 840 square feet and meet other relevant requirements for the zoning district of the site. The 840-square-foot requirement shall be for freestanding homes without any additions or build-ons.
(7) To obtain a waiver for a prefab or mobile home, the applicant must present; at the time of application, a copy of the title for the prefab or mobile home that is subject to the application or the MSO for the prefab or mobile home, if it is new.
(B) Utilities requirements.
(1) Sewer and other utilities. Prefab and mobile homes must meet all applicable state and town regulations regarding utilities.
(2) Propane prohibited. No new propane connections are allowed.
(C) Anchoring. Prefab and mobile homes must be tied down according to state regulations and underpinning must be completed within 30 days of installation.
(D) Employee occupancy. Where placement of prefab, mobile home, recreational vehicle or travel trailer is contemplated for employee occupancy for a period of time greater than 30 days, water and sanitary sewer connections shall be installed.
