§ 6-6-15 COW, GOATS AND HORSES PROHIBITED WITHIN TOWN LIMITS UNLESS
PROVISIONS MET.
   (A)   Cows, goats, horses, mules and other large animals prohibited in town limits, unless the following conditions are met, to wit:
      (1)   It is unlawful for any person, persons, firm or corporation to keep, stable or pen any cow, goat, horse, mule or other large animal in the town limits;
      (2)   Persons allowed to keep, stable, pen or maintain any cow, goat, horse, mule or other large animal within the town limits shall be the legal owner of a minimum of two acres for the first animal and an additional one acre for each additional animal, up to a total of three animals and four acres; and
      (3)   The provision of this section shall not include the existing sale barns located within the town limits.
   (B)   Penalty for violation of this section is as follows.
      (1)   Any person, persons, firm or corporation who violates this section, first offense, shall be given notice to remove such animals within 72 hours. Any subsequent violation would be punishable by fine without further notice.
      (2)   Any person, persons, firm or corporation in violation of this section shall be punished by a fine not to exceed $100.
      (3)   Each day or any portion of a day during which any violation of this code or of any ordinance shall constitute a separate offense.
      (4)   Enforcement of this section shall be the duty and responsibility of the animal control officer or the Chief of Police or any other law enforcement officer hired by the town.
   (C)   The condition cited herein impact the safety, welfare and health of the citizens of the town and for that reason, the emergency clause is necessary to make this chapter enforceable upon the date Its passage.
