It shall not be necessary to vacate a plat, or part thereof, in order to proceed with the resubdivision of said plat, or part thereof; provided, any dedications to the public of roads or other public lands in the original subdivision must be rededicated in the resubdivision; provided further, that the resubdivision retain any easements or rights-of-way for public utilities appearing in the original subdivision. Such resubdivision according to the procedure and standards for subdivisions required by this chapter shall automatically constitute vacation of a prior plat or part thereof. However, if it is proposed to vacate any roads or other public grounds or if the rights of public utilities in any easements or rights-of-way are proposed to be abridged, the plat must be vacated under the procedures set forth in §§ 153.080 through 153.084.
