§ 130.01 CURFEW.
   (A)   It shall be unlawful for any child under the age of 18 years to be on any public street, alley, or public place in the village between the hours of 11:00 p.m. and 6:00 a.m. Sunday through Thursday, inclusive, and between the hours of 12:01 a.m. and 6:00 a.m. on Saturday and Sunday unless accompanied by or in the charge of a parent or legal guardian of the age of 21 years or more, or unless such person is engaged in a business or occupation which the laws of the state authorize a person less than 18 years of age to perform.
   (B)   It is unlawful for any parent, guardian, or other person having the legal care and custody of any person under 18 years of age to allow or permit any such child, ward, or other person under such age to go, or be in or upon any of the streets, alleys, or public places within the time prohibited by division (A) of this section, unless accompanied as provided in said division, or unless there exists a reasonable necessity therefore.
   (C)   A person under the age of 18 years who knowingly violates this section shall be subject to a penalty as provided. The police officer shall forthwith and without delay, report such violation to his superior officer, who shall cause a written notice to be served upon the parent, guardian, custodian, or other person in control or charge of such child, setting forth the manner in which this section has been violated.
