§ 52.042 DRIVEWAY APPROACHES.
   (A)   Driveway approaches shall be the responsibility of the builder and shall be completed, inspected and approved by the Building Inspector prior to the issuance of an occupancy permit.
   (B)   All driveway approaches shall extend from the edge of the road pavement to the lot line of the parcel and shall be constructed in accordance with the specifications set forth in Section (B)(2)(b) of the Design and Construction Policy For Improvement of the Village of Winthrop Harbor.
   (C)   All driveway approaches shall be not less than 12-feet wide and not more than 24-feet wide at the point of intersection with the lot line of the parcel.
   (D)   No driveway approach shall flare more than three feet past its width at the lot line at the point of intersection with the road pavement, unless the Director of Public Works shall have given specific written permission to do so after finding a site-specific safety need that requires the same.
   (E)   The allowing or requiring of a driveway approach to connect to the public street over village right-of-way constitutes a mere license to the owner of the property served by the driveway. Nothing in this section, this chapter or this code evidences any intent of the village to abandon its ownership or any and all rights it has in the full right-of-way under its jurisdiction and control.
   (F)   Construction over the village's right-of-way is subject to strict compliance with the permit given under this section. Any driveway approach shall be constructed of the same material as the driveway unless a waiver is granted. The Superintendent of Public Works has the sole discretion to issue a waiver allowing the use of alternative materials when he or she finds that the waiver will not pose any danger to public health, safety, comfort or welfare. Such a waiver will be in writing, and will be maintained on file with the property's building file.
