§ 36.06 SKATE PARK.
   (A)   The village recognizes that the skate park facility located in the Village Park has unique attributes due to the potential for injuries to the users of the facility, while at the same time recognizing that the facility has the potential for providing a substantial recreational asset to the community, and provides a much safer environment, despite this potential for injury, than open skating on the streets of the village.
   (B)   The village further recognizes that the skate park equipment is expensive to purchase, install and maintain, that these facilities are used by a relatively small portion of the population of the village, and that there are certain persons who will disregard safety rules, no matter how reasonable, and endanger themselves and others while using facilities of this nature.
   (C)   It is for the above reasons that the village adopts this section.
   (D)   The Recreation Director shall post a set of rules and regulations for the use of the skate park, which may include hours of operation and prohibit illegal or grossly unsafe activities such as drinking of alcohol, smoking or the use of home-made or personally-owned skating equipment, including but not limited to ramps, half-pipes and the like.
   (E)   Any person found to be in violation of this section may be barred from the use of the skate park and shall be subject to any other fines and penalties that he or she may be liable for under any other section of this code or of the laws of the state.
   (F)   If a person is barred from the use of the skate park pursuant to division (E) above, the Recreation Director or his or her designee is specifically authorized to physically remove the offender, and if he or she refuses to leave, then to have him or her charged by the police with criminal trespass to property.
   (G)   In the event any part of this section is found to be unenforceable or unconstitutional by a court of competent jurisdiction, such finding shall not affect the balance of this section, which shall remain in full force and effect.
