§ 33.08 ON-DUTY CONDUCT.
   Members of the Fire Department shall be considered to be on duty in the following instances:
   (A)   While in Department uniform (or in certain emergency situations where dress in Department uniform cannot be readily accomplished) and on properties occupied by the Fire Department, such as offices, garages, and other work areas.
   (B)   When as a member of the Department a person is responding to an emergency situation, regardless of whether or not an alarm has been turned in.
   (C)   Members of the Department, except in those instances stated in
divisions (A) and (B) above, will not be deemed to be on duty.
