§ 31.023 PRESIDENT PRO TEM.
   (A)   During the temporary absence or disability of the Village President, the Board of Trustees shall elect one of its number to act as President Pro Tem, who during the absence or disability of the President shall perform the duties pertaining to the office.
   (B)   (1)   However, if a vacancy occurs in the office of the President and there remains an unexpired portion of the term of at least one year, the vacancy shall be filled by a special election which shall be held within six months after the vacancy occurs. The Board of Trustees shall elect one of its members as acting President who shall perform the duties and possess all the rights and powers of the President until a successor to fill the vacancy has been elected and qualified.

      (2)   If the unexpired portion of the term is less than one year, the vacancy shall be filled by the Board of Trustees until a President is elected at the next regular election and has qualified. Further, when the unexpired portion is less than one year, there can be no special election.
